SOMMAIRE
Le texte modifie le Code criminel afin d’exiger que le rapport présentenciel fasse état de tout aspect de l’état mental du délinquant qui est pertinent quant à la détermination de la peine.
SUMMARY
This enactment amends the Criminal Code to require that a presentence report contain information on any aspect of the offender’s mental condition that is relevant for sentencing purposes.

Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1 Le paragraphe 721(3) du Code criminel est modifié par adjonction, après l’alinéa a), de ce qui suit :
1 Subsection 721(3) of the Criminal Code is amended by adding the following after paragraph (a):
-
a.1) Insertion start tout aspect de l’état mental du Insertion end délinquant Insertion start qui est pertinent quant à la détermination de la peine Insertion end , ainsi que les Insertion start services et le soutien en matière Insertion end de santé mentale à sa disposition;
-
(a.1) any Insertion start aspect of Insertion end the offender’s mental Insertion start condition that is relevant for sentencing purposes, Insertion end as well as any mental health Insertion start services or support Insertion end available to Insertion start the offender Insertion end ;
