SOMMAIRE
Le texte modifie le Code criminel afin de prévoir des peines spécifiques pour vol de matériel de lutte contre les incendies. Il prévoit également que le fait qu’un méfait soit commis à l’égard de matériel de lutte contre les incendies constitue une circonstance aggravante pour la détermination de la peine. Enfin, il établit des objectifs pour la détermination de la peine pour ce genre de vol.
SUMMARY
This enactment amends the Criminal Code to establish specific penalties related to the theft of firefighting equipment. It also creates an aggravating circumstance for sentencing if the mischief involves firefighting equipment. Finally, it establishes sentencing objectives in relation to the theft of such equipment.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1 Le Code criminel est modifié par adjonction, après l’article 333.1, de ce qui suit :
1 The Criminal Code is amended by adding the following after section 333.1:
Vol de matériel de lutte contre les incendies
Theft of firefighting equipment
333.2 Quiconque commet un vol est coupable d’un acte criminel passible de l’emprisonnement à perpétuité si l’objet volé constitue du matériel de lutte contre les incendies et que le vol cause un danger réel pour la vie des gens.
End of inserted block333.2 Everyone who commits theft is, if the property stolen is firefighting equipment and the theft causes actual danger to life, guilty of an indictable offence and liable to imprisonment for life.
End of inserted block2 La même loi est modifiée par adjonction, après l’article 430, de ce qui suit :
2 The Act is amended by adding the following after section 430:
Circonstance aggravante — méfait à l’égard de matériel de lutte contre les incendies
Aggravating circumstance — mischief relating to firefighting equipment
430.1 Le tribunal qui impose une peine pour une infraction prévue à l’article 430 est tenu de considérer comme une circonstance aggravante le fait que le méfait a été commis à l’égard de matériel de lutte contre les incendies.
End of inserted block430.1 When a court imposes a sentence for an offence under section 430, it shall consider as an aggravating circumstance the fact that the property in relation to which the mischief occurred is firefighting equipment.
End of inserted block3 La même loi est modifiée par adjonction, après l’article 718.02, de ce qui suit :
3 The Act is amended by adding the following after section 718.02:
Objectifs — vol de matériel de lutte contre les incendies
Objectives — theft of firefighting equipment
718.021 Le tribunal qui impose une peine pour une infraction prévue à l’article 322, si l’infraction concerne le vol de matériel de lutte contre les incendies, accorde une attention particulière aux objectifs de dénonciation et de dissuasion de l’agissement à l’origine de l’infraction.
End of inserted block718.021 When a court imposes a sentence for an offence under section 322, the court shall, if the theft involves firefighting equipment, give primary consideration to the objectives of denunciation and deterrence of the conduct that forms the basis of the offence.
