SUMMARY
This enactment amends the Criminal Code to establish specific penalties related to the theft of firefighting equipment. It also creates an aggravating circumstance for sentencing if the mischief involves firefighting equipment. Finally, it establishes sentencing objectives in relation to the theft of such equipment.

An Act to amend the Criminal Code (firefighting equipment) |
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1 The Criminal Code is amended by adding the following after section 333.1:
Theft of firefighting equipment
Start of inserted block333.2 Everyone who commits theft is, if the property stolen is firefighting equipment and the theft causes actual danger to life, guilty of an indictable offence and liable to imprisonment for life.
End of inserted block2 The Act is amended by adding the following after section 430:
Aggravating circumstance — mischief relating to firefighting equipment
Start of inserted block430.1 When a court imposes a sentence for an offence under section 430, it shall consider as an aggravating circumstance the fact that the property in relation to which the mischief occurred is firefighting equipment.
End of inserted block3 The Act is amended by adding the following after section 718.02:
Objectives — theft of firefighting equipment
Start of inserted block718.021 When a court imposes a sentence for an offence under section 322, the court shall, if the theft involves firefighting equipment, give primary consideration to the objectives of denunciation and deterrence of the conduct that forms the basis of the offence.
