Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
|

1. Subsection 2(1) of the Fisheries Act is amended by adding the following in alphabetical order:
|
|
|

“eviscerated” means a condition in which the organs within the body cavity have been completely removed;

“invasive carp” refers to any of the following of the cyprinid species:
|
|
|
|
(a) grass carp (Ctenopharyngodon idella),
|
|
|
|
(b) silver carp (Hypophthalmichthys molitrix),
|
|
|
|
(c) bighead carp (Hypophthalmichthys nobilis), or
|
|
|
|
(d) black carp (Mylopharyngodon piceus);
|
|
|
|
« carpe envahissante » S’entend de l’une ou l’autre des espèces de cyprinidés suivantes :

|
« carpe envahissante »
“invasive carp”
|
|
a) la carpe de roseau (Ctenopharyngodon idella);
|
|
|
|
b) la carpe argentée (Hypophthalmichthys molitrix);

2. The Act is amended by adding the following after section 33.1:

33.2 It is prohibited for a person to send or convey from one province to another — or to import — invasive carp that has not been eviscerated.

33.3 It is prohibited for a person to sell, offer for sale or have in their possession invasive carp that has not been eviscerated.

3. The portion of subsection 40(1) of the Act before paragraph (a) is replaced by the following:

40. (1) Every person who contravenes section 33.2 or 33.3 or subsection 35(1) is guilty of an offence and liable

Rights, powers and obligations
|
|
50.1 (1) For the purposes of the enforcement of sections 33.2 and 33.3, officers, within the meaning of that term in section 2 of the Customs Act, have the rights, powers and obligations of fishery officers under sections 49 to 52 of this Act.
|

|

Duty to assist
|
|
(2) The owner or person in charge of a place that is inspected by an officer in the exercise of the rights, powers and obligations referred to in subsection (1) and every person found in the place shall
|
|
|
|
(a) give the officer all reasonable assistance to enable the officer to carry out the inspection and exercise any power conferred by this section; and
|
|
|
|
(b) provide the officer with any information relevant to the administration of this Act or the regulations that the officer may reasonably require.
|

|
(2) Le propriétaire ou le responsable d’un lieu qui fait l’objet d’une visite menée par un agent dans l’exercice de ses droits, pouvoirs et obligations visés au paragraphe (1), ainsi que toute personne qui s’y trouve, sont tenus d’accorder à l’agent toute l’assistance possible dans l’exercice de ses fonctions et de lui donner les renseignements qu’il peut valablement exiger dans le cadre de l’application de la présente loi ou de ses règlements.
