An Act respecting the Marine Mammal Regulations (seal fishery observation licence)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Within 60 days after this Act comes into force, the Governor in Council is to make the following amendments to the Marine Mammal Regulations:

1. Dans les soixante jours suivant l’entrée en vigueur de la présente loi, le gouverneur en conseil apporte les modifications suivantes au Règlement sur les mammifères marins :

(a) paragraph 32(2)(d) is replaced by the following:

(d) whether the applicant has a stated aim of disrupting the seal fishery or has been convicted, in the five years preceding the application for the licence, of tagging, marking or moving a live seal, of contravening subsection 33(1) or of violating a condition of a seal fishery observation licence; and

a) l’alinéa 32(2)d) est remplacé par ce qui suit :

d) le fait que le demandeur puisse avoir comme but avoué de perturber la pêche du phoque ou qu’il ait déjà été condamné, dans les cinq années précédant la demande, pour avoir étiqueté, marqué ou déplacé un phoque vivant, avoir contrevenu au paragraphe 33(1) ou avoir contrevenu à une condition d’un permis délivré en vertu du paragraphe (1);

33. (1) Subject to subsection (2), no person shall, except under the authority of a seal fishery observation licence issued by the Minister, approach within one nautical mile of a person who is fishing for seals.

33. (1) Sous réserve du paragraphe (2), il est interdit à quiconque n’est pas titulaire d’un permis d’observation pour la pêche du phoque délivré par le ministre de s’approcher à moins d’un mille marin d’une personne qui pêche le phoque.

(e) to a person who resides on land within one nautical mile of a person who is fishing for seals.
