An Act to amend the Criminal Code (hate propaganda)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

CRIMINAL CODE
1. Subsection 318(4) of the Criminal Code is replaced by the following:
Definition of “identifiable group”
(4) In this section, “identifiable group” means any section of the public distinguished by colour, race, religion, ethnic origin, sex or sexual orientation.
COORDINATING AMENDMENT
Bill C-389
2. If Bill C-389, introduced in the 2nd session of the 40th Parliament and entitled An Act to amend the Canadian Human Rights Act and the Criminal Code (gender identity and gender expression), receives royal assent, then, on the first day on which both section 4 of that Act and section 1 of this Act are in force, subsection 318(4) of the Criminal Code is replaced by the following:
