An Act to amend the Criminal Code (motor vehicle theft)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

CRIMINAL CODE
1. The Criminal Code is amended by adding the following after section 334:
Punishment for motor vehicle theft
334.1 Every one who commits theft of a motor vehicle is
(a) in the case of a first offence,
(i) guilty of an offence punishable on summary conviction, or
(ii) guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; and
(b) in the case of a second or subsequent offence, guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.
COORDINATING AMENDMENTS

2. (1) Subsections (2) to (4) apply if Bill C-343, introduced in the 2nd session of the 39th Parliament and entitled An Act to amend the Criminal Code (motor vehicle theft) (the “other Act”), receives royal assent.
(2) If section 1 of this Act comes into force after section 1 of the other Act, section 1 of this Act is replaced by the following:
1. Section 334.1 of the Criminal Code is replaced by the following :
Punishment for motor vehicle theft
334.1 Every one who commits theft of a motor vehicle is
(a) in the case of a first offence,
(i) guilty of an offence punishable on summary conviction, or
(ii) guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; and
(b) in the case of a second or subsequent offence, guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.
(3) If section 1 of the other Act comes into force on the same day as section 1 of this Act, then, section 1 of the other Act is deemed to have come into force before section 1 of this Act and subsection (2) applies as a consequence.
(4) If section 1 of this Act comes into force before section 1 of the other Act, then section 1 of the other Act is repealed.
