SUMMARY
The purpose of this enactment is to give greater protection to emergency medical services workers under the Criminal Code.

An Act to amend the Criminal Code (emergency medical services workers)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Section 2 of the Criminal Code is amended by adding the following in alphabetical order:
“emergency medical services worker”

“emergency medical services worker” means any person who works as an emergency medical responder or as a primary, advanced or critical care paramedic and who is employed in, or appointed or assigned to, an ambulance service or other emergency medical service;
2. Subsection 231(4) of the Act is amended by striking out the word “or” at the end of paragraph (b), by adding the word “or” at the end of paragraph (c) and by adding the following after paragraph (c):
(d) an emergency medical services worker acting in the course of his or her duties.
3. Subsection 268(2) of the Act is replaced by the following:
Aggravated assault
(1.1) Every one commits an aggravated assault who wounds, maims, disfigures or endangers the life of an emergency medical services worker acting in the course of his or her duties.
Punishment
(2) Every one who commits an aggravated assault under subsection (1) is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years.

(2.1) Every one who commits an aggravated assault under subsection (1.1) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.
4. Paragraph 270(1)(a) of the Act is replaced by the following:
(a) assaults a public officer, peace officer or emergency medical services worker engaged in the execution of his or her duty, or a person acting in aid of such an officer or worker;
5. Section 433 of the Act is amended by striking out the word “or” at the end of paragraph (a), by adding the word “or” at the end of paragraph (b) and by adding the following after paragraph (b):
(c) the fire or explosion causes death or bodily harm to an emergency medical services worker who is acting in response to the fire or explosion.
