An Act to amend the Employment Insurance Act and the Employment Insurance Regulations (excluding pension from earnings when calculating employment insurance benefits)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

EMPLOYMENT INSURANCE ACT
1. Subsection 108(1) of the Employment Insurance Act is amended by adding the following after paragraph (g):
(g.1) for permitting a claimant to not include in the claimant’s earnings moneys paid to the claimant on account of or in lieu of a pension;

2. (1) Subsection 35(2) of the Employment Insurance Regulations is amended by adding the word “and” at the end of paragraph (d) and by repealing paragraph (e).
(2) Subsection 35(5) of the Regulations is repealed.
(3) Paragraph 35(7)(e) of the Regulations is replaced by the following:
(e) the moneys paid or payable to a claimant on a periodic basis or in a lump sum on account of or in lieu of a pension; and
3. Subsections 36(14) to (17) of the Regulations are repealed.
4. Paragraph 94(b) of the Regulations is repealed.
