SUMMARY
This enactment requires the Minister of the Environment to add perfluorooctane sulfonate (PFOS) to the Virtual Elimination List compiled under subsection 65(2) of the Canadian Environmental Protection Act, 1999 within nine months after the coming into force of this enactment. The Minister must also make regulations prescribing the quantity or concentration of that substance that may be released into the environment, either alone or in combination with any other substance, in order to achieve the virtual elimination of the substance.

An Act to add perfluorooctane sulfonate (PFOS) to the Virtual Elimination List under the Canadian Environmental Protection Act, 1999
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
SHORT TITLE
Short title
1. This Act may be cited as the Perfluorooctane Sulfonate Virtual Elimination Act.
INTERPRETATION
Definitions
2. The following definitions apply in this Act.
“level of quantification”

“level of quantification” means, in respect of a substance, the lowest concentration that can be accurately measured using sensitive but routine sampling and analytical methods.
“Minister”

“Minister” means the Minister of the Environment.
“virtual elimination”
« quasi-élimination »
« quasi-élimination »
“virtual elimination” means the ultimate reduction of the quantity or concentration of a substance released into the environment to below the level of quantification.
ADDITION TO THE LIST
Addition of perfluorooctane sulfonate
3. (1) Despite anything in the Canadian Environmental Protection Act, 1999 or the regulations made under that Act, the Minister shall, within nine months after the coming into force of this Act, add perfluorooctane sulfonate to the Virtual Elimination List compiled under subsection 65(2) of that Act and shall specify the level of quantification for that substance.
Quantity or concentration that may be released
(2) The Minister shall, within nine months after specifying the level of quantification for perfluorooctane sulfonate, make regulations prescribing the quantity or concentration of that substance that may be released into the environment, either alone or in combination with any other substance from any source or type of source, in order to achieve the virtual elimination of perfluorooctane sulfonate.
