SUMMARY
This enactment requires the Minister of the Environment to make regulations prohibiting the use of benzyl butyl phthalate (BBP), dibutyl phthalate (DBP) and di(2-ethylhexyl)phthalate (DEHP) in certain products within 12 months after the enactment comes into force.
The enactment also amends Schedule 1 to the Canadian Environmental Protection Act, 1999 to include benzyl butyl phthalate (BBP), dibutyl phthalate (DBP) and di(2-ethylhexyl)phthalate (DEHP).
SOMMAIRE
Le texte oblige le ministre de l’Environnement à prendre des règlements interdisant l’utilisation de phtalate de butylbenzyle (BBP), de phtalate de dibutyle (DBP) et de phtalate de di(2-éthylhexyle) (DEHP) dans certains produits dans les douze mois suivant l’entrée en vigueur du texte.
En outre, le texte modifie l’annexe 1 de la Loi canadienne sur la protection de l’environnement (1999) afin d’y inclure le phtalate de butylbenzyle (BBP), le phtalate de dibutyle (DBP) et le phtalate de di(2-éthylhexyle) (DEHP).

1. This Act may be cited as the Phthalate Control Act.

3. The Minister shall, within 12 months after the coming into force of this Act, make regulations prohibiting the use of

(a) benzyl butyl phthalate (BBP) with respect to

(i) products for use by a child in learning or play, and

(ii) products that are put in the mouth of an infant when used, including feeding bottle nipples, teethers, soothers, pacifiers and other similar products;

(b) dibutyl phthalate (DBP) with respect to

(i) cosmetics,

(ii) products for use by a child in learning or play, and

(iii) products that are put in the mouth of an infant when used, including feeding bottle nipples, teethers, soothers, pacifiers and other similar products; and

(c) di(2-ethylhexyl)phthalate (DEHP) with respect to

(i) cosmetics,

(ii) medical devices, other than blood bags,

(iii) products for use by a child in learning or play, and

(iv) products that are put in the mouth of an infant when used, including feeding bottle nipples, teethers, soothers, pacifiers and other similar products.
3. Dans les douze mois suivant l'entrée en vigueur de la présente loi, le ministre prend des règlements interdisant l’utilisation :

a) de phtalate de butylbenzyle (BBP) dans :

(i) les produits destinés à l’éducation ou à la récréation des enfants,

(ii) les produits destinés à être portés à la bouche des bébés, y compris les tétines de biberons, jouets de dentition, tétines, sucettes et autres produits similaires;

b) de phtalate de dibutyle (DBP) dans :

(i) les cosmétiques,

(ii) les produits destinés à l’éducation ou à la récréation des enfants,

(iii) les produits destinés à être portés à la bouche des bébés, y compris les tétines de biberons, jouets de dentition, tétines, sucettes et autres produits similaires;

c) de phtalate de di(2-éthylhexyle) (DEHP) dans :

(i) les cosmétiques,

(ii) les instruments médicaux, sauf les sacs de sang,

(iii) les produits destinés à l’éducation ou à la récréation des enfants,

(iv) les produits destinés à être portés à la bouche des bébés, y compris les tétines de biberons, jouets de dentition, tétines, sucettes et autres produits similaires.
