An Act to provide for a national cancer strategy

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Short title

1. This Act may be cited as the National Cancer Strategy Act.

2. The following definition applies in this Act.

“Minister”

“Minister” means the Minister of Health.

Consultation

3. The Minister shall, within 90 days following the coming into force of this Act, consult with

(a) every minister responsible for the delivery of health services in a province, and

(b) every charity that is a registered charity under the Income Tax Act and that the Minister considers has, as its main objective, the funding of research into cancer,

to discuss the establishment of a national cancer strategy under this Act.

3. Dans les quatre-vingt-dix jours suivant l’entrée en vigueur de la présente loi, le ministre est tenu, afin de discuter de l’établissement d’une stratégie nationale contre le cancer aux termes de la présente loi, de consulter :

a) le ministre responsable de la prestation des services de santé de chaque province;

b) chaque organisme de bienfaisance enregistré au sens de la Loi de l’impôt sur le revenu dont l’objectif premier consiste, de l’avis du ministre, à financer la recherche sur le cancer.

Proposal to Parliament

4. The Minister, after the consultation required by section 3, shall cause to be presented to each House of Parliament, on one of the first 5 days on which the House sits after the expiry of 180 days following the coming into force of this Act, a proposal for the establishment of:

(a) a national cancer strategy that provides for the Minister, and the ministers responsible for the delivery of health services in the provinces that agree to participate in the strategy, to coordinate the application of

(i) funds appropriated by Parliament,

(ii) funds appropriated by the legislatures of the provinces that agree to participate in the strategy, and

(iii) funds raised by charities that agree to participate in the strategy,

to finance research in Canada into the causes of cancer and its most effective treatments; and

(b) a committee to advise the Minister on the coordination referred to in paragraph (a), consisting of

(i) a person designated by each of the ministers of the provinces referred to in paragraph (a), and

(ii) one or more persons designated by the Minister to represent the charities referred to in subparagraph (a)(iii).

4. Après avoir procédé à la consultation prévue à l’article 3, le ministre fait présenter à chaque chambre du Parlement, dans les cinq premiers jours de séance de celle-ci suivant l’expiration du délai de 180 jours après la date d’entrée en vigueur de la présente loi, une proposition pour l’établissement :

a) d’une stratégie nationale contre le cancer qui prévoit la coordination, par le ministre et les ministres responsables de la prestation des services de santé des provinces qui acceptent de participer à la stratégie, de l’emploi des fonds consacrés à la recherche au Canada sur les causes et les traitements les plus efficaces du cancer, qui sont :

(i) soit affectés par le Parlement,

(ii) soit affectés par la législature des provinces qui acceptent de participer à la stratégie,

(iii) soit recueillis par un organisme de bienfaisance qui accepte de participer à la stratégie;

b) d’un comité chargé de conseiller le ministre sur les questions de coordination visées à l’alinéa a) et composé :

(i) d’une personne désignée par chacun des ministres provinciaux visés à l’alinéa a),

(ii) d’une ou de plusieurs personnes désignées par le ministre pour représenter les organismes de bienfaisance visés au sous-alinéa a)(iii).

5. (1) The Leader of the Government in the Senate shall move a motion in the Senate providing for a debate on the proposal presented under section 4 during the first 15 days on which the Senate sits after the presentation of the proposal.

5. (1) Le leader du gouvernement au Sénat y présente une motion proposant la tenue d’un débat sur la proposition visée à l’article 4 au cours des quinze premiers jours de séance du Sénat suivant la présentation de la proposition.

(2) The Minister shall move a motion in the House of Commons providing for a debate on the proposal presented under section 4 during the first 15 days on which the House sits after the presentation of the proposal.

(2) Le ministre présente à la Chambre des communes une motion proposant la tenue d’un débat sur la proposition visée à l’article 4 au cours des quinze premiers jours de séance de celle-ci suivant la présentation de la proposition.

6. The Minister, after taking into consideration the debates in each House that take place as a result of the motions referred to in section 5, shall, on one of the first 5 days on which the House of Commons sits after the expiry of 90 days following the conclusion of the debates, introduce the legislation that the Minister considers necessary to establish a national cancer strategy.

6. Après avoir tenu compte des débats tenus dans les deux chambres du Parlement par suite des motions visées à l’article 5, le ministre doit, dans les cinq premiers jours de séance de la Chambre des communes suivant l’expiration des quatre-vingt-dix jours après la clôture de ces débats, déposer le projet de loi qu’il juge nécessaire pour établir une stratégie nationale contre le cancer.
