The Standing Joint Committee for the Scrutiny of Regulations met at 8:41
a.m., this day, in room 160-S, Centre Block, the Joint Chairs, the Honourable
Céline Hervieux-Payette, P.C., and Mr. Gurmant Grewal, M.P., presiding.
Members of the committee present:
Representing the Senate: The Honourable Senators Michel Biron, Céline
Hervieux-Payette, P.C, James F. Kelleher, P.C., Wilfred P. Moore, and Pierre
Claude Nolin (5).
Other senator present: The Honourable Fernand Robichaud, P.C. (1).
Representing the House of Commons: Andy Burton (for Maurice
Vellacott), Georges Farrah (for Joe Comuzzi), Gurmant Grewal, Derek Lee, Paul

The committee proceeded to the consideration of the following draft budget
for the fiscal year ending March 31, 2004.

Mr. Lee moved the adoption of the draft budget application.
The question being put on the motion, it was adopted.
The Committee proceeded to consider its permanent Order of Reference, section
19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:
Every statutory instrument issued, made or established after December 31,
1971, other than an instrument the inspection of which and the obtaining of
copies of which are precluded by any regulations made pursuant to paragraph
20(d), shall stand permanently referred to any committee of the House
of Commons, of the Senate or of both Houses of Parliament that may be
established for the purpose of reviewing and scrutinizing statutory
instruments.
The committee considered SOR/2002-225 — Regulations Amending Certain
Regulations Made Under the Fisheries Act (Miscellaneous Program), and SOR/93-332
— Aboriginal Communal Fishing Licences Regulations.
On C.R.C.c. 954 — Indian Estates Regulations, it was agreed that the Joint
Chairs correspond with the Minister of Indian Affairs and Northern Development
with respect to certain comments made by the committee.
The Committee considered C.R.C.c. 1325 — Public Land Mineral Regulations,
SOR/2002-246 — Regulations Amending Certain Department of Indian Affairs and
Northern Development Instruments (Miscellaneous Program), and SOR/92-738 —
Railway Interswitching Regulations, amendment.
On SOR/90-82 — Ship-source Oil Pollution Fund Regulations, it was agreed that
the file be closed.
On SOR/2000-46 — Regulations Amending the Licensing and Arbitration
Regulations, it was agreed that this file be postponed to the next meeting.
On SOR/99-12 — Preliminary Screening Requirement Regulations, it was agreed
that Counsel to the Committee review their status at a later date and inform the
committee of the action taken.
On SOR/95-410 — Schedules I and III to the Act, amendment, it was agreed that
Counsel to the Committee correspond with the Designated Instruments Officer of
the Department of Transport with respect to certain comments made by the
committee.
On SOR/99-158 — Regulations Amending the Canadian Aviation Regulations (Part
VII), it was agreed that Counsel to the Committee review their status at a later
date and inform the committee of the action taken.
On SOR/89-331 — Selkirk Marine Railway Dry Dock Regulations, 1989; SOR/89-332
— Esquimalt Graving Dock Regulations, 1989; SOR/95-462 — Esquimalt Graving Dock
Regulations, 1989, amendment; and SOR/98-115 — Regulations Amending the Weights
and Measures Regulations, it was agreed that Counsel to the Committee review
their status at a later date and inform the committee of the action taken.
On SOR/97-138 — Indian Bands Council Elections Order, it was agreed that the
file be closed.
On SOR/97-473 — Kananaskis Falls and Horseshoe Falls Water Power Regulations,
it was agreed that Counsel to the Committee review their status at a later date
and inform the committee of the action taken.
On SOR/98-215 — Importation and Exportation of Firearms Regulations
(Individuals), it was agreed that Counsel to the Committee review their status
at a later date and inform the committee of the action taken.
