The Standing Joint Committee for the Scrutiny of Regulations met at 8:35 a.m., this day, in room 256-S, Centre Block, the Joint Chair, the Honourable Céline Hervieux-Payette, P.C., presiding.

Members of the committee present:

Representing the Senate: The Honourable Senators Céline Hervieux-Payette, P.C. and Wilfred P. Moore (2).

Representing the House of Commons: Jim Abbott (for Gurmant Grewal), John Cummins, Derek Lee, Paul Macklin, John Maloney, Lynn Myers, Caroline St-Hilaire, Tom Wappel, and Ted White (9).

In attendance: Till Heyde, Joint Clerk of the Committee (Senate) and Joann Garbig, Joint Clerk of the Committee (House of Commons), and François-R. Bernier and Jacques Rousseau, Counsel to the Committee, Research Branch, Library of Parliament.

Also present: The official reporters of the Senate.

The committee proceeded to consider its permanent Order of Reference, section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The committee considered a draft report on SOR/97-144 — Broadcasting Licence Fee Regulations, 1997.

At 8:40 a.m., the committee proceeded in camera.

At 9:06 a.m., the committee resumed in public.

Mr. Lee moved that the report be adopted with amendments.

The question being put on the motion, it was adopted.

After debate, the committee continued with its agenda.

On SOR/89-330 — Lauzon Dry Docks Regulations, 1989, SOR/89-331 — Selkirk Marine Railway Dry Dock Regulations 1989, SOR/89-332 — Esquimalt Graving dock Regulations, 1989, and SOR/95-462 — Esquimalt Graving Dock Regulations, 1989, amendment, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/92-620 — Corrections and Conditional Release Regulations, and SOR/96-108 — Corrections and Conditional Release Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of the Solicitor General with respect to certain comments made by the committee.

On SOR/96-470 — Employment Equity Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Human Resources Development with respect to certain comments made by the committee.

On SOR/91-499 — Canadian International Trade Tribunal Rules, and SOR/2000-139 — Rules amending the Canadian International Trade Tribunal Rules, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Finance with respect to certain comments made by the committee.

On SOR/2000-205 — Class II Nuclear Facilities and Prescribed Equipment Regulations, and SOR/2000-204 — Class I Nuclear Facilities Regulations, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canadian Nuclear Safety Commission with respect to certain comments made by the committee.

On SOR/2002-170 — Regulations Amending Certain Regulations Made under the Canada Oil and Gas Operations Act (Miscellaneous Program), and SOR/96-115 — Canada Oil and Gas Production and Conservation Regulations amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Natural Resources with respect to certain comments made by the committee.

On Parks Canada Master List of Fees, 2003-2004, Parks Canada Master List of Fees, 2002-2003, and Parks Canada Master List of Fees, 2002-2001, it was agreed that the Joint Chairs correspond with the Minister of Canadian Heritage with respect to certain comments made by the committee.

On SOR/96-255 — Special Import Measures Regulations, amendment, it was agreed that the file be closed.
