An Act to amend the Canada Student Financial Assistance Act (financial assistance relating to Convention refugees and their education needs)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Canada Student Financial Assistance Act

1. Paragraph (a) of the definition ``qualifying student'' in subsection 2(1) of the Canada Student Financial Assistance Act is replaced by the following:

    (a) who is a Canadian citizen or a permanent resident within the meaning of the Immigration Act or who is determined to be a Convention refugee by the Immigration and Refugee Board under that Act,

Conditional Amendment

2. If Bill C-31, introduced in the 2nd session of the 36th Parliament and entitled An Act respecting immigration to Canada and the granting of refugee protection to persons who are displaced, persecuted or in danger (referred to in this section as the ``other Act''), receives royal assent, then on the later of the day on which the other Act or section 1 of this Act comes into force, paragraph (a) of the definition ``qualifying student'' in subsection 2(1) of the Canada Student Financial Assistance Act, as enacted by section 1 of this Act, is replaced by the following:

    (a) who is a Canadian citizen or a permanent resident within the meaning of the Immigration and Refugee Protection Act or who is determined to be a Convention refugee or a person in need of protection by the Immigration and Refugee Board under that Act,
