An Act to amend the Nuclear Energy Act and
the Nuclear Safety and Control Act

SHORT TITLE |
|
Short title
|
1. This Act may be cited as the Nuclear
Amendment Act, 1998.
|
|

2. The definition ``Minister'' in section 2
of the Nuclear Energy Act is replaced by the
following:
|
|
``Minister'' « ministre »
|
``Minister'' means the Minister of Industry;
|
|
|
3. The Act is amended by adding the
following after section 11:
|
|
Transfer of
shares
|
11.1 (1) Any shares of the company Atomic
Energy of Canada Limited that are held or
owned by the Minister of Natural Resources
under subsection 11(1) as it read immediately
before the coming into force of this section are
hereby transferred to the Minister of Industry
who is hereby authorized to acquire the shares.

Registration
and holding
of shares
|
(2) The shares transferred to the Minister by
subsection (1) shall be registered in the books
of the company Atomic Energy of Canada
Limited in the name of the Minister and shall
be held or owned, as the case may be, by the
Minister in trust for Her Majesty in right of
Canada.

4. (1) The definition ``Minister'' in
section 2 of the Nuclear Safety and Control
Act is replaced by the following:
|
|
``Minister'' « ministre »
|
``Minister'' means the Minister of the
Environment.
|
|
|
(2) Section 127 of the Act is replaced by
the following:
|
|
Coming into
force
|
127. (1) Subject to subsection (2), this Act
comes into force on a day to be fixed by order
of the Governor in Council.
|
|
Exception
|
(2) If this Act is not in force on the day the
Nuclear Amendment Act, 1998 is assented to,
this Act shall come into force on a day to be
fixed by the Governor in Council that is not
later than 60 days after that assent.
