An Act to amend the Canadian Security Intelligence Service Act (Review Committee)

R.S., c. C-23; c. 1 (4th Supp.); 1993, c. 34; 1995, c. 5; 1996, c. 18

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsections 34(1) to (3) of the Canadian Security Intelligence Service Act are replaced by the following:

Security Intelligence Review Committee

34. (1) There is hereby established a committee, to be known as the Security Intelligence Review Committee, consisting of a Chairman and not less than two and not more than four other members, all of whom shall be appointed by the Governor in Council, after each federal general election, within the first four months that the House of Commons is sitting, from among members of the Queen's Privy Council for Canada who are not members of the Senate or the House of Commons

    (a) with the approval of the leader of each party having at least twelve members in the House of Commons; and

    (b) after approval, by resolution of that House.

Term of office

(2) Each member of the Review Committee shall be appointed to hold office during good behaviour until the member has been replaced pursuant to an appointment made under subsection (1).

Absence or incapacity

(3) In the event of the absence or incapacity of a member of the Review Committee, other than the Chairman, or if a seat is vacant, the Governor in Council may appoint a new member of the Review Committee from among members of the Queen's Privy Council for Canada who are not members of the Senate or the House of Commons

    (a) with the approval of the leader of each party having at least twelve members in the House of Commons; and

    (b) after approval, by resolution of that House.

Transitional

2. A person who is a member of the Review Committee on the day this Act comes into force shall continue to sit on the Review Committee until the member has been replaced under subsection 34(1).
