TRANSITIONAL

Person holding office of Director

38. (1) The person holding the office of Director of Investigation and Research immediately before the coming into force of section 4 shall continue in office as the Commissioner of Competition referred to in section 7 of the Competition Act, as amended by this Act.

Persons holding office as Deputy Director

(2) Every person holding the office of Deputy Director of Investigation and Research immediately before the coming into force of section 5 shall continue in office as a Deputy Commissioner of Competition referred to in section 8 of the Competition Act, as enacted by this Act.

Outstanding prohibition orders

39. An order made under section 34 of the Competition Act in respect of an offence under any of sections 52, 53 or 57 to 59 of that Act, as those sections read immediately before the coming into force of sections 12, 14 and 17 of this Act, is deemed to have been made under paragraph 74.1(1)(a) of the Competition Act, as enacted by section 22 of this Act.

Variation or rescission of orders

40. Subsection 34(2.3) of the Competition Act, as enacted by subsection 11(2) of this Act, applies in respect of orders made under section 34 of the Competition Act whether before or after the coming into force of section 11 of this Act.

CONSEQUENTIAL AND RELATED AMENDMENTS

Competition Tribunal Act

41. Subsection 8(1) of the Competition Tribunal Act is replaced by the following:

Jurisdiction

8. (1) The Tribunal has jurisdiction to hear and dispose of all applications made under Part VII.1 or VIII of the Competition Act and any related matters.

42. Subsection 9(3) of the Act is replaced by the following:

Interventions by persons affected

(3) Any person may, with leave of the Tribunal, intervene in any proceedings before the Tribunal, other than proceedings under Part VII.1 of the Competition Act, to make representations relevant to those proceedings in respect of any matter that affects that person.

43. Section 11 of the Act is replaced by the following:

Interim orders

11. (1) The Chairman of the Tribunal, sitting alone , or a judicial member designated by the Chairman, sitting alone, may hear and dispose of applications for interim orders under subsection 100(1) or 104(1) of the Competition Act and any related matters.

Administra-
tive remedies

(2) Applications for orders under Part VII.1 of the Competition Act and any related matters shall be heard and disposed of by the Chairman of the Tribunal, sitting alone, or by a judicial member designated by the Chairman, sitting alone.

44. (1) Section 2 of the Consumer Packaging and Labelling Act is renumbered as subsection 2(1) and is amended by adding the following in alphabetical order:

(2) The functions of the Minister of Industry in relation to the administration of this Act except subsection 11(1), and in relation to the enforcement of this Act except as it relates to food, as that term is defined in section 2 of the Food and Drugs Act, may be exercised by the Commissioner on behalf of that Minister.

45. Subsection 70.5(1) of the Copyright Act is replaced by the following:

70.5 (1) For the purposes of this section and section 70.6, ``Commissioner '' means the Commissioner of Competition appointed under the Competition Act.

46. The Act is amended by replacing the word ``Director'' with the word ``Commissioner'' in the following provisions:

    (a) subsections 70.5(4) and (5); and

    (b) subsections 70.6(1) and (2).

Criminal Code

47. The definition ``offence'' in section 183 of the Criminal Code is amended by adding the word ``or'' immediately before the reference to ``202(1)(e) (pool-selling, etc.)'' and by adding immediately after that reference the words ``of this Act, section 45 (conspiracy), 47 (bid-rigging) or 52.1 (deceptive telemarketing) of the Competition Act,''.
