An Act to amend the Food and Drugs Act (labelling for prepackaged foods)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Food and Drugs Act is amended by adding the following after section 5:

5.1 (1) No prepackaged food shall be sold at retail that has been genetically altered or that contains an ingredient that has been genetically altered unless the prepackaged food has affixed to it a label containing a declaration, in the prescribed form,

    (a) stating that the prepackaged food or one of its ingredients, as the case may be, has been genetically altered; and

    (b) identifying the prepackaged food or listing the ingredients in the prepackaged food that have been genetically altered.

Definitions

(2) In this section,

``prepac-
kaged food''
« aliment préemballé »

``prepackaged food'' means any food that is packaged in a container in such a manner that it is ordinarily sold to or used or purchased by a consumer without being re-packaged.

``genetic alteration''
« modifica-
tion génétique
»

``genetic alteration'' means genetic alteration or development through a prescribed biotechnological process.

2. Subsection 30(1) of the Act is amended by adding the following after paragraph (l):

    (l.1) defining the term ``biotechnological process'' in section 5.1;
