The Standing Joint Committee for the Scrutiny of Regulations met at 8:38 a.m., this day, in room 256-S, Centre Block, the Joint Chairs, the Honourable Céline Hervieux-Payette, P.C. and Mr. Gurmant Grewal, M.P., presiding.

Members of the committee present:

Representing the Senate: The Honourable Senators Michel Biron, Céline Hervieux-Payette, P.C., Mobina S. B. Jaffer, and James F. Kelleher, P.C. (4).

Representing the House of Commons: Andy Burton (for John Cummins), Ken Epp (for Ted White), Gurmant Grewal, Derek Lee, Paul Macklin, John Maloney, John McKay, Lynn Myers, Caroline St-Hilaire, and Tom Wappel (10).

In attendance: Joann Garbig, Joint Clerk of the Committee (House of Commons), François-R. Bernier and Jacques Rousseau, Counsel to the Committee, Research Branch, Library of Parliament.

Also present: The official reporters of the Senate.

The committee considered its permanent Order of Reference, section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which follows:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

Mr. Lee moved that the committee adopt the following schedule for meetings to the summer of 2003, subject to changes necessitated by the sitting schedule of the two Houses: Thursday, February 20, Thursday, March 20, Thursday, April 3, Thursday, April 10, Thursday, May 1, Thursday, May 15, Thursday, May 29, and Thursday, June 12, 2003.

The question being put on the motion, it was adopted.

On SOR/2002-225 — Regulations Amending Certain Regulations Made Under the Fisheries Act (Miscellaneous Program), it was agreed that Departmental officials be invited to appear on February 20, 2003.

It was agreed that normal confidentiality surrounding the draft document taken into consideration at this meeting on this matter be dispensed with.

On SOR/97-270 — Marine Transportation Security Regulations (Cruise Ships and Cruise Ship Facilities), it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/98-258 — Regulations Amending the Canada Pension Plan Regulations, it was agreed that the Joint Chairs correspond with the Minister of Human Resources with respect to certain comments made by the committee and that other correspondence be sent.

On SOR/2000-327 — Regulations Amending the Income Tax Regulations (Natural Resources), it was agreed that the file be closed.

On SI/97-95 — Certain Taxpayers Remission Order, 1997-3, it was agreed that the file be closed.

On SOR/94-787 — Manufactured Tobacco Imported for Further Manufacture Remission Order, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/95-419 — Accounting for Imported Goods and Payment of Duties Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Canada Customs and Revenue Agency with respect to certain comments made by the committee.

On SOR/95-467 — Veterans Burial Regulations, 1995 and SOR/95-468 — Last Post Fund Regulations, 1995, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On C.R.C. c. 568 — Denatured Alcohol Regulations, it was agreed that the Joint Chairs correspond with the Minister of National Revenue with respect to certain comments made by the committee.

On C.R.C. c. 231 — Prince Edward Island Milk Marketing Levies Order, it was agreed that Counsel to the Committee prepare certain correspondence and that the file then be closed.

On SOR/95-25 — Investment Canada Regulations, amendment, it was agreed that Counsel to the Committee correspond with the Designated Instruments Officer of the Department of Industry with respect to certain comments made by the committee.

On SOR/93-4 — Dangerous Chemicals and Noxious Liquid Substances Regulations, it was agreed that Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/99-326 — Regulations Amending the Children's Special Allowance Regulations, it was agreed that the Joint Chairs correspond with the Minister of National Revenue with respect to certain comments made by the committee.

The committee considered the following:
