The Standing Joint Committee for the Scrutiny of Regulations met at 9:00 a.m., this day, in room 256-S, Centre Block, the Joint Chairmen, Senator Céline Hervieux-Payette and Gurmant Grewal, M.P., presiding.

Members of the committee present:

Representing the Senate: The Honourable Senators: Ethel Cochrane, Céline Hervieux-Payette, P.C. and Wilfred P. Moore (3).

Representing the House of Commons: Ken Epp, Gurmant Grewal, Pierrette Venne and Tom Wappel (4).

Other members present: Derek Lee.

In attendance: Normand Radford, Joint Clerk of the Committee (House of Commons); Parliamentary Research Branch: François-R. Bernier, General Counsel to the Committee; Peggy Jodoin-Rasmussan, Counsel to the Committee.

Also in attendance: The official reporters of the Senate.

The committee continued its consideration of its permanent Order of Reference, section 19, The Statutory Instruments Act, R.S.C. 1985, c. S-22, which follows:

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The Clerk provided a progress report on the invitation to the Minister of Transport to attend a meeting of the committee regarding SOR/858 -- Air Transportation Regulations; SOR/92-738 -- Railway Interswitching Regulations, amendment; and SOR/94-240 -- Canada Ports Corporation Administrative By-law, revocation, et al. The committee noted that, after two months, the Minister had still not made a commitment to attend.

It was moved by Mr. Wappell, -- That the Minister of Transportation be ordered to attend a regularly scheduled meeting of this committee before the summer adjournment to address the above-referenced matters.

The question being put on the motion, it was adopted.

The Honourable Céline Hervieux-Payette, Joint Chair, provided a progress report on Canada's offer, in response to Australia's invitation, to host the 5th Commonwealth Conference on Delegated Legislation. The Joint Chair noted that the Coordinating committee is now chaired from New Zealand, and that New Zealand is pursuing Zimbabwe to host the conference. Canada's offer to host is on hold pending further developments.

The committee reviewed the following statutory instruments:

On SOR/96-447 -- Royal Canadian Mounted Police Public Complaints Commission Rules of Practice, amendment (before the committee on June 11, 1998 and May 13, 1999);

It was moved by Mr. Wappell, -- That Ms Shirley Heafey, Chair of the RCMP Public Complaints Commission, be called as a witness before the committee.

The question being put on the motion, it was agreed.

On SOR/95-467 -- Veterans Burial Regulations, 1995 and SOR/95-468 -- Last Post Fund Regulations, 1995 (Before the committee on February 11, 1999);

It was agreed, -- That Counsel to the Committee review their status at a later date and inform the committee of the action taken.

On SOR/90-829 -- Canada Pension Plan Regulations, amendment (Before the committee on May 18, 1995, April 2, 1998 and April 6, 2000);

It was agreed, -- That the Joint Chairmen correspond with the Minister of Human Resources Development Canada with respect to certain comments made by the committee.

On SOR/95-256 -- Manitoba Fishery Regulations, 1987, amendment;

It was agreed, -- That the Joint Chairmen correspond with the Minister of Fisheries and Oceans Canada with respect to certain comments made by the committee

On SOR/99-202 -- Order Cancelling General Export Permit No. Ex. 11 -- Libya;

It was agreed, -- That the file be closed.
