The Standing Joint Committee for the Scrutiny of Regulations met at 8:47 a.m., this day, in room 256-S, Centre Block, the Joint Chairman, Gurmant Grewal, M.P., presiding.

Members of the committee present:

Representing the Senate: The Honourable Senators Sheila Finestone, P.C., and Céline Hervieux-Payette, P.C. (2).

Representing the House of Commons: Gurmant Grewal, Derek Lee, Jacques Saada and Pierrette Venne (4).

In attendance: From the Parliamentary Research Branch: François-R. Bernier, General Counsel to the Committee; Jacques Rousseau, Counsel to the Committee.

Also in attendance: The official reporters of the Senate.

The committee continued its consideration of its permanent Order of Reference, section 19, The Statutory Instruments Act, R.S.C. 1985, c. S-22, which follows:

19. Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

On SOR/99-26 -- Regulations Amending the Royal Canadian Mounted Police Regulations, 1988 (before the committee on March 4, 1999, June 3, 1999, February 17, 2000, March 2, 2000 and April 6, 2000),

It was agreed, -- That the Joint Chairmen correspond with the Solicitor General with respect to certain comments made by the committee and it was agreed to report the matter.

The question being put on the motion, it was agreed, on division.

Mr. Saada informed the committee that he has spoken with the Minister of Justice regarding the disallowance procedure for regulations made by arm's length organizations.

On SOR/94-439 -- National Parks Camping Regulations, amendment; and

SOR/94-512 -- National Parks General Regulations, amendment (before the committee on September 26, 1996 and March 19, 1998),

It was agreed, -- That the Joint Chairmen correspond with the Minister of Canadian Heritage with respect to certain comments made by the committee.

On SOR/98-258 -- Regulations Amending the Canada Pension Plan Regulations (before the committee on February 11, 1999),

It was agreed, -- That Counsel to the Committee review their status at a later date and inform the Committee of the action taken.

It was agreed, -- That the Joint Chairmen correspond with the President of the Treasury Board with respect to certain comments made by the committee and That the letter and response be sent to the Senate Transport and Communications Committee and the House of Commons' Heritage Committee.

On SOR/98-31 -- Order Respecting the Remission of a Portion of the Customs Duties and Excise Taxes on Imports of Certain Woollen Fabrics,

It was agreed, -- That the file be closed.

On SOR/98-221 -- Order Amending the Advance Income Tax Ruling Fees Order;

It was agreed, -- That Counsel to the Committee correspond with the Designated Instruments Officer of the CRTC with respect to certain comments made by the committee; and -- That the committee send copies of counsel's letter and the response to the Senate Committee on Transport and Communications and the Commons' Heritage Committee.

It was agreed, -- That the files be closed.

On SOR/97-568 -- Recovery of Overpayments Made to Former Members of Parliament Regulations,

It was agreed, -- That Counsel to the Committee correspond with the Designated Instruments Officer of the Treasury Board with respect to certain comments made by the committee.

The committee considered SOR/98-23 -- Remission Order in Respect of Goods Under the Customs Duties Regulations or Removal Order, 1988.

On SI/99-19 -- Proclamation giving notice that the annexed November 30, 1995 supplementary agreement, entitled Protocol to the Tax Convention Between the Government of Canada and the Government of the French Republic signed on May 2, 1975 and amended by the Protocol of January 16, 1987, came into force on September 1, 1998; and
