Préambule

Attendu :

que les cours d’eau, qui sont à la fois sources et milieux de vie, doivent être préservés et protégés;

qu’il y a lieu de reconnaître le droit qu’a le fleuve Saint-Laurent d’exister et de couler, de maintenir ses cycles vitaux, sa biodiversité naturelle et son intégrité, de remplir des fonctions essentielles au sein de son écosystème, d’être nourri par des aquifères et affluents, d’être protégé contre la contamination et de se regénérer;

qu’il y a lieu de reconnaître que tous les peuples autochtones qui vivent aux abords du fleuve Saint-Laurent et qui le naviguent depuis des millénaires sont les gardiens traditionnels du fleuve et veillent à sa protection, à la mise en valeur de ses droits et à son intérêt supérieur;

qu’il y a lieu de souligner l’importance d’entités naturelles tel le fleuve Saint-Laurent en les dotant de la personnalité juridique;

que la fiction juridique ainsi créée est nécessaire pour garantir au fleuve Saint-Laurent un environnement sain, au bénéfice des générations présentes et futures, et pour renforcer sa protection,

Preamble

Whereas watercourses, which are both sources of life and living environments, must be preserved and protected;

Whereas it is necessary to recognize the St. Lawrence River’s right to exist and flow, to maintain its vital cycles, natural biodiversity and integrity, to fulfil essential functions within its ecosystem, to be nourished by its aquifers and tributaries, to be protected against contamination and to regenerate;

Whereas it is necessary to recognize that all Indigenous peoples who are living on the borders of the St. Lawrence River and who have navigated it over millennia are the traditional custodians of the River and ensure its protection, the enhancement of its rights and its best interest;

Whereas the importance of natural entities such as the St. Lawrence River should be emphasized by recognizing them as having legal personality;

And whereas the legal fiction thus created is necessary to guarantee the St. Lawrence River a healthy environment, to the benefit of current and future generations, and to enhance its protection;

2 The following definitions apply in this Act.

Committee means the St. Lawrence River Protection Committee established by section 6. (Comité)

Indigenous governing body means a council, government or other entity that is authorized to act on behalf of an Indigenous group, community or people that holds rights recognized and affirmed by section 35 of the Constitution Act, 1982. (corps dirigeant autochtone)

Indigenous peoples has the meaning assigned by the definition aboriginal peoples of Canada in subsection 35(2) of the Constitution Act, 1982. (peuples autochtones)

Minister means the Minister of the Environment. (ministre)

River means the St. Lawrence River and includes its fauna, flora and bed. (Fleuve)

3 For greater certainty, nothing in this Act is to be construed as abrogating or derogating from the protection provided for the rights of Indigenous peoples by the recognition and affirmation of those rights in section 35 of the Constitution Act, 1982.

4 (1) La présente loi a pour objet, à la fois :

  • a) de donner la capacité d’une personne physique au Fleuve afin de protéger le droit qu’il a d’exister et de couler, de maintenir ses cycles vitaux, sa biodiversité naturelle et son intégrité, de remplir des fonctions essentielles au sein de son écosystème, d’être nourri par des aquifères et affluents, d’être protégé de la contamination et de se regénérer;

  • b) de constituer le Comité sur la protection du Fleuve Saint-Laurent, chargé d’agir au nom du Fleuve.

4 (1) The purposes of this Act are

  • (a) to give the River the capacity of a natural person in order to protect its right to exist and flow, to maintain its vital cycles, natural biodiversity and integrity, to fulfil essential functions within its ecosystem, to be nourished by its aquifers and tributaries, to be protected from contamination and to regenerate; and

  • (b) to establish the St. Lawrence River Protection Committee, responsible for acting on behalf of the River.

(2) This Act is not intended to prohibit either recreational uses of the River or subsistence uses, such as fishing, that are carried out in a responsible manner and that preserve the health of the River and its ecosystem.

5 (1) The River has the capacity and the rights, powers and privileges of a natural person, including the right to institute legal proceedings.

6 (1) Le Comité sur la protection du fleuve Saint-Laurent est constitué.

  • a) deux sont recommandés par le gouvernement de l’Ontario;

  • b) deux sont recommandés par le gouvernement du Québec;

  • c) deux sont recommandés par des corps dirigeants autochtones concernés de la province d’Ontario;

  • d) deux sont recommandés par des corps dirigeants autochtones concernés de la province de Québec;

  • e) trois sont recommandés par des organisations non gouvernementales concernées des provinces d’Ontario ou de Québec.

(2) The Committee is to consist of eleven members appointed by the Governor in Council, including

  • (a) two members recommended by the Government of Ontario;

  • (b) two members recommended by the Government of Quebec;

  • (c) two members recommended by relevant Indigenous governing bodies from the Province of Ontario;

  • (d) two members recommended by relevant Indigenous governing bodies from the Province of Quebec; and

  • (e) three members recommended by relevant non-governmental organizations from the provinces of Ontario or Quebec.

(6) Avant que prenne fin leur mandat, ils revoient la composition du Comité et les critères de nomination de ceux qui leur succèderont, le cas échéant, et incluent à leur rapport prévu au paragraphe 12(1) toute recommandation de changement jugé nécessaire.

(6) Before their term of office expires, the Members must review the composition of the Committee and the appointment criteria for their successors, as the case may be, and include any recommendation for change that they consider necessary in the report provided for in subsection 12(1).

(8) Each member is to be paid the remuneration fixed by the Governor in Council and is entitled to be paid reasonable travel and other expenses incurred in the course of their duties and functions under this Act while absent from their ordinary place of work.

7 Le Comité est mandataire du Fleuve et, à ce titre, il le représente dans l’exercice de ses droits, au mieux de ses intérêts.

7 The Committee is the agent of the River and, as its representative, exercises the rights of the River in its best interests.

8 Le Comité est notamment chargé :

  • a) de promouvoir des activités de sensibilisation du public relatives au Fleuve;

  • b) d’intervenir et de donner son avis lors de consultations, d’audiences publiques et d’évaluations d’impact environnemental concernant des autorisations de projets pouvant affecter le Fleuve;

  • c) d’agir comme mandataire du Fleuve devant les tribunaux;

  • d) de communiquer avec les autorités publiques concernées en cas de préjudice réel ou éventuel;

  • e) de soumettre au ministre des recommandations visant la protection, la restauration et la régénération des eaux du Fleuve;

  • f) d’entreprendre de façon prioritaire des actions visant l’atténuation de tout préjudice causé au Fleuve et la restauration de ses écosystèmes;

  • g) de proposer des mesures concrètes et respectueuses du Fleuve qui visent à garantir l’accès sécuritaire à celui-ci et à ses affluents pour les activités communautaires et récréotouristiques;

  • h) de participer à la mise en œuvre de plans et de programmes touchant la gestion et la conservation de l’habitat et des écosystèmes du Fleuve.

8 The duties of the Committee include

  • (a) promoting activities to raise public awareness of the River;

  • (b) intervening and advising during consultations, public hearings and environmental impact assessments connected with the authorization of projects that might affect the River;

  • (c) acting as the River’s agent before the courts;

  • (d) communicating with the relevant public authorities in the event of real or potential damage;

  • (e) submitting recommendations to the Minister on ways to protect, restore and regenerate the waters of the River;

  • (f) acting on a priority basis to mitigate any harm done to the River and to restore its ecosystems;

  • (g) proposing concrete measures that respect the River to guarantee secure access to the River and its tributaries for community and tourist activities; and

  • (h) participating in the implementation of plans and programs for the management and conservation of the River’s habitat and ecosystems.

9 Le Comité peut retenir temporairement les services d’experts ou de spécialistes dont la compétence lui est utile dans l’exercice des attributions que lui confèrent la présente loi; il peut fixer et payer, avec l’approbation du Conseil du Trésor, leur rémunération et leurs frais.

9 The Committee may engage on a temporary basis the services of persons having technical or specialized knowledge of any matter relating to its work to advise and assist the Committee in the exercise of its powers or the performance of its duties and functions under this Act and, with the Treasury Board’s approval, may fix and pay their remuneration and expenses.

11 (1) Le Comité peut intenter une action en réparation au nom du Fleuve s’il est d’avis qu’un fait — acte ou omission — en contravention de toute loi fédérale ou provinciale a causé ou est susceptible de causer un préjudice important au Fleuve.

11 (1) The Committee may bring an action for damages on behalf of the River if it is of the opinion that an act or omission in contravention of any Act of Parliament or of a provincial legislature caused or is likely to cause substantial damages to the River.

12 (1) Chaque année, le Comité présente au ministre un rapport portant sur ses activités pour l’année précédente et faisant état de toute action en réparation intentée en vertu du paragraphe 11(1).

12 (1) Each year, the Committee must present the Minister with a report detailing the activities of the previous year and report on any action for damages brought under subsection 11(1).

(2) Le ministre fait déposer le rapport devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant sa réception.

(2) The Minister must cause the report to be tabled before each House of Parliament on any of the first 15 days on which that House is sitting after the Minister receives it.
