SOMMAIRE
Le texte modifie la Loi sur l’aéronautique afin d’y prévoir la tenue de consultations avant l’aménagement ou l’agrandissement d’un aérodrome ou avant que tout changement soit apporté à son exploitation.
SUMMARY
This enactment amends the Aeronautics Act to provide for the holding of consultations before the development or expansion of an aerodrome or before any change is made to its operation.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1 La Loi sur l’aéronautique est modifiée par adjonction, après l’article 4.87, de ce qui suit :
1 The Aeronautics Act is amended by adding the following after section 4.87:

4.88 (1) Le promoteur qui se propose d’aménager un aérodrome ou l’exploitant d’un aérodrome qui se propose d’agrandir un aérodrome ou d’apporter tout changement à son exploitation en avise le ministre et les parties intéressées.
Fin du bloc inséré4.88 (1) A promoter who intends to develop an aerodrome or the operator of an aerodrome who intends to expand it or to make any changes to its operation must advise the Minister and any interested parties.

(2) Pour l’application du paragraphe (1), les parties intéressées sont les suivantes :
a) les fournisseurs de services de navigation aérienne;
b) les administrations locales et municipales dont une partie du territoire se trouve dans un rayon de 4 km de l’aérodrome;
c) les propriétaires d’immeubles situés dans un rayon de 4 km de l’aérodrome;
d) les personnes susceptibles d’être directement touchées par le projet;
e) toute autre personne que le gouverneur en conseil peut désigner par règlement.

(a) suppliers of air navigation services;
(b) local and municipal governments any part of whose territory is within 4 km of the aerodrome;
(c) owners of buildings located within 4 km of the aerodrome;
(d) persons likely to be directly affected by the project; and
(e) any other person that the Governor in Council may prescribe by regulation.

Project description
(3) Le promoteur ou l’exploitant, selon le cas, fournit au ministre et aux parties intéressées une description du projet qui comprend les renseignements que le gouverneur en conseil peut prévoir par règlement.
Fin du bloc inséré(3) The promoter or operator, as the case may be, must provide the Minister and interested parties with a description of the project that contains the information that the Governor in Council may prescribe by regulation.

(4) S’il estime que la description est incomplète ou imprécise, le ministre peut, dans les dix jours suivant sa réception, exiger du promoteur ou de l’exploitant, selon le cas, qu’il lui en fournisse une version modifiée assortie des renseignements et précisions que le ministre demande.
Fin du bloc inséré(4) If the Minister deems the description incomplete or imprecise, he or she may, within 10 days of its receipt, require the promoter or operator, as the case may be, to provide an amended version containing the information and specifications that the Minister requests.

(5) Lorsqu’il estime que la description du projet comprend tous les renseignements requis, le ministre nomme une personne qui n’a aucun intérêt dans le projet pour agir à titre de responsable de la tenue de consultations publiques sur le projet.
Fin du bloc inséré(5) When, in the opinion of the Minister, the project description contains all the requested information, the Minister must then appoint a disinterested person to hold public consultations on the project.

(6) Les honoraires du responsable et les coûts découlant des consultations sont à la charge du promoteur ou de l’exploitant, selon le cas.
Fin du bloc inséré(6) The promoter or operator, as the case may be, must pay the fees of the person holding the consultations and any expenses related to those consultations.

(7) Pour déclencher les consultations, le responsable rend publique la description du projet et invite les parties intéressées à faire part de leurs observations dans le délai et en la forme qu’il prévoit dans l’invitation.
Fin du bloc inséré(7) To initiate consultations, the person holding the consultations must publish the project description and invite interested parties to submit their observations within the period and in the form set out in the invitation.

Report
(8) Le responsable soumet au ministre et au promoteur ou à l’exploitant, selon le cas, un rapport faisant état du résultat des consultations et précisant notamment :
a) les parties intéressées qui ont participé aux consultations;
b) la mesure dans laquelle le projet respecte les plans d’aménagement et les règles de droit établis par la province ou les administrations locales, municipales ou régionales;
c) les observations, sous forme de résumé, et les mesures prévues pour en tenir compte, le cas échéant.
Fin du bloc inséré(8) The person holding the consultations must submit to the Minister and the promoter or operator, as the case may be, a report on the results of the consultations that includes specifications regarding
(a) the interested parties that participated in the consultations;
(b) the extent to which the project respects the development plans and rules established by the province or the local, municipal or regional governments; and
(c) the observations, in summarized form, and any measures provided for in response to those observations.

(9) Le ministre publie le rapport sur le site Internet du ministère des Transports pour une période minimale de cinq ans.
