SOMMAIRE
Le texte modifie la Loi sur le ministère de la Santé afin de constituer un comité consultatif chargé de recueillir et de rendre publics des renseignements sur l’instauration d’un régime public universel d’assurance-médicaments.
SUMMARY
This enactment amends the Department of Health Act in order to establish an advisory committee charged with gathering and making public information on the establishment of universal public coverage for prescription medication.

Advisory Committee established
5.1 (1) Est constitué le Comité consultatif sur l’instauration d’un régime public d’assurance-médicaments, composé de cinq membres nommés par le gouverneur en conseil pour un mandat renouvelable d’au plus cinq ans.
Fin du bloc inséré5.1 (1) There is established a committee, to be known as the Advisory Committee on Public Coverage for Prescription Medication, consisting of five members appointed by the Governor in Council for a term not exceeding five years, which term may be renewed for one or more further terms.

Mandate
(2) Le comité consultatif a pour mandat, d’une part, de prodiguer conseils et assistance au ministre en matière de régime public d’assurance-médicaments couvrant les médicaments sur ordonnance et, d’autre part, de recueillir et de rendre publics des renseignements sur l’instauration d’un tel régime, par la prise des mesures suivantes :
a) la collecte et l’analyse de données tirées de recherches avancées et indépendantes évaluées par les pairs portant sur les régimes publics d’assurance-médicaments ainsi que, au besoin, la commande de recherches pour obtenir des connaissances pertinentes;
b) la consultation des intéressés au Canada et à l’étranger concernant l’instauration d’un régime public universel d’assurance-médicaments;
c) l’étude des modèles de régime existants et proposés dans les provinces et à l’étranger afin d’établir les pratiques exemplaires;
d) la consultation des représentants des gouvernements fédéral, provinciaux et territoriaux ainsi que des Premières Nations au sujet des modèles de régime public universel d’assurance-médicaments, dans le but d’établir le modèle le mieux adapté au Canada compte tenu des considérations juridiques et culturelles;
e) la formulation de recommandations au ministre sur l’instauration d’un régime public universel d’assurance-médicaments.
Fin du bloc inséré(2) The mandate of the Advisory Committee is to advise and assist the Minister with respect to public coverage for prescription medication and to gather and make public information on the establishment of universal public coverage for prescription medication by
(a) collecting and analyzing leading, independent and peer-reviewed research on public coverage for prescription medication and commissioning research, where needed, to acquire relevant knowledge;
(b) consulting with relevant stakeholders in Canada and abroad regarding the establishment of universal public coverage for prescription medication;
(c) studying existing and proposed models of public coverage for prescription medication in other jurisdictions to determine best practices;
(d) meeting with representatives of the federal, provincial and territorial governments and of First Nations to discuss models of universal public coverage for prescription medication and to determine the most suitable model for Canada, taking into account relevant legal and cultural considerations; and
(e) making recommendations to the Minister regarding the establishment of universal public coverage for prescription medication.

Remuneration of Chair
(4) Le président reçoit la rémunération fixée par le gouverneur en conseil.

Travel, living and other expenses
(5) Les membres sont indemnisés des frais, notamment de déplacement et de séjour, entraînés par l’exercice de leurs attributions hors du lieu de leur résidence habituelle, conformément aux directives du Conseil du Trésor.
Fin du bloc inséré(5) The members of the Advisory Committee are entitled to be reimbursed, in accordance with Treasury Board directives, for travel, living and other expenses incurred in connection with their work for the committee while absent from their ordinary place or residence.

Meetings
(6) Le comité se réunit au moins quatre fois par année, aux date, heure et lieu fixés par son président.
Fin du bloc inséré(6) The Chair may determine the times and places at which the Advisory Committee will meet, but it must meet at least four times a year.
