An Act to amend the Criminal Code (firefighters)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
|
|
|

1. Section 2 of the Criminal Code is amended by adding the following in alphabetical order:
|
|
|
|

“firefighter” means any person employed in, or appointed or assigned to, a fire department;

2. Subsection 231(4) of the Act is amended by striking out the word “or” at the end of paragraph (b), by adding the word “or” at the end of paragraph (c) and by adding the following after paragraph (c):

Aggravated assault
|
|
(1.1) Every one commits an aggravated assault who wounds, maims, disfigures or endangers the life of a firefighter acting in the course of his or her duties.
|
|
|
|
(1.1) Commet des voies de fait graves quiconque blesse, mutile ou défigure un pompier agissant dans l’exercice de ses fonctions ou met la vie de celui-ci en danger.

(2) Every one who commits an aggravated assault under subsection (1) is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years.
|
|

(2) Quiconque commet des voies de fait graves aux termes du paragraphe (1) est coupable d’un acte criminel et passible d’un emprisonnement maximal de quatorze ans.

5. Section 433 of the Act is amended by striking out the word “or” at the end of paragraph (a), by adding the word “or” at the end of paragraph (b) and by adding the following after paragraph (b):

(c) the fire or explosion causes death or bodily harm to a firefighter who is acting in response to the fire or explosion.
