Summary

Sommaire

This enactment amends the Nuclear Energy Act in order to make Atomic Energy of Canada Limited, the federal organization responsible for research, development and marketing of nuclear energy, accountable to the Minister of Industry rather than the Minister of Natural Resources. The enactment also transfers those shares of Atomic Energy of Canada Limited that are held by the Minister of Natural Resources to the Minister of Industry.

Le texte modifie la Loi sur l’énergie nucléaire afin de confier au ministre de l’Industrie, plutôt qu’au ministre des Ressources naturelles, la responsabilité d’Énergie atomique du Canada limitée, l’organisme fédéral chargé de la recherche sur l’énergie nucléaire, de son exploitation et de sa commercialisation. Le ministre de l’Industrie se voit également transférer les actions d’Énergie atomique du Canada limitée détenues par le ministre des Ressources naturelles.

1. The definition “Minister” in section 2 of the Nuclear Energy Act is replaced by the following:

2. The Act is amended by adding the following after section 11:

Transfer of shares

11.1 (1) Any shares of the company Atomic Energy of Canada Limited that are held or owned by the Minister of Natural Resources under subsection 11(1) as it read immediately before the coming into force of this section are hereby transferred to the Minister of Industry, who is hereby authorized to acquire the shares.

11.1 (1) Les actions d’Énergie atomique du Canada limitée détenues par le ministre des Ressources naturelles en application du paragraphe 11(1), dans sa version antérieure à l’entrée en vigueur du présent article, sont transférées au ministre de l’Industrie, qui est autorisé à les acquérir.

Registration and holding of shares

(2) The shares transferred to the Minister by subsection (1) shall be registered in the books of the company Atomic Energy of Canada Limited in the name of the Minister and shall be held or owned, as the case may be, by the Minister in trust for Her Majesty in right of Canada.

(2) Les actions transférées au ministre au titre du paragraphe (1) sont inscrites dans les livres d’Énergie atomique du Canada limitée au nom du ministre et sont détenues par lui en fiducie pour Sa Majesté du chef du Canada.
