Sommaire

 The purpose of this enactment is to amend the Criminal Code in order  to give greater protection to persons acting to preserve and maintain public health and safety by creating a new offence of first degree murder and increasing the punishment for aggravated assault when the victim is one of those persons.

Le texte a pour objet de modifier le Code criminel afin d’améliorer la protection accordée aux personnes qui agissent de façon à préserver et maintenir la santé et la sécurité publiques en créant l’infraction de meurtre au premier degré et en augmentant la peine pour voies de fait graves dans les cas où une de ces personnes en est la victime.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 231(4) of the Criminal Code is amended by striking out the word “or” at the end of paragraph (b), by adding the word “or” at the end of paragraph (c) and by adding the following after paragraph (c):

(d) a person who is acting to preserve and maintain public health or safety.

2. (1) Subsection 268(2) of the Act is replaced by the following:

Punishment

(2) Every one who commits an aggravated assault is guilty of an indictable offence and liable

(a) where the complainant is a person described in subsection 231(4), to imprisonment for a term not exceeding twenty years; and

(b) in any other case, to imprisonment for a term not exceeding fourteen years.

(2) Quiconque commet des voies de fait graves est coupable d’un acte criminel et passible :

a) si le plaignant est une personne visée au paragraphe 231(4), d’un emprisonnement maximal de vingt ans;

b) dans les autres cas, d’un emprisonnement maximal de quatorze ans.

 3. Section 433 of the Act is renumbered as subsection 433(1) and is amended by adding the following:

Public safety occupation

(2) Where a fire or explosion causes death or bodily harm to a person described in subsection 231(4), the sentence of imprison-ment for life is a minimum punishment.

(2) Si le feu ou l’explosion inflige des lésions corporelles ou la mort à une personne visée au paragraphe 231(4), la peine d’empri-sonnement à perpétuité est une peine mini-male.
