Preamble
|
Whereas veterans of the Canadian Forces have over the years
made great sacrifices in combat and in peacekeeping duties;
Whereas, as dedicated individuals, they have served
honourably and courageously in defence of Canada’s freedoms and values;
Whereas their devotion to duty has greatly contributed to Canada’s
security, peace and prosperity;
And Whereas it
is appropriate to pay tribute to such devotion by the establishment of a
national program to honour their memory on the occasion of their death;
Now,
Therefore, Her Majesty, by and
with the advice and consent of the Senate and House of Commons of Canada,
enacts as follows:

depuis de nombreuses années, les anciens combattants des Forces canadiennes
ont fait d’énormes sacrifices au combat et dans les fonctions de maintien de
la paix;
que, par
leur dévouement, ils ont contribué avec honneur et courage à la défense des
libertés et valeurs du peuple canadien;

leur sens du devoir, ils ont grandement contribué à la sécurité, à la paix et
à la prospérité du Canada;
qu’il
convient de rendre hommage à un tel dévouement en créant un programme
national visant à honorer leur mémoire à l’occasion de leur décès,

1. This Act may be cited as the National

2. The definitions in this section apply in

other than for misconduct or unsatisfactory service.
“Minister” means the Minister of
Veterans Affairs.

3. The Minister, in consultation with the
Minister of National Defence, shall establish a national program to honour
the memory of every veteran on the occasion of the death of the veteran, if
the veteran was honourably released from the Canadian Forces.

décès, la mémoire de tout ancien
combattant qui a obtenu une libération honorable des Forces canadiennes.

Elements of the program
|
4. Where the death of a veteran has been
reported to the Minister, the Minister, in consultation with the next of kin
of the veteran, shall
(a) provide an honour guard of at
least two uniformed members of the Canadian Forces to be present at the
funeral ceremony of the veteran;
(b) arrange for the coffin or
other container that contains the remains of the veteran to be draped with
the Canadian flag;
(c) if appropriate, arrange for a
gun salute or similar military honour; and
(d) provide any other appropriate
honours that the Minister, in consultation with the next of kin, considers
necessary or desirable for the occasion.

4. Le ministre, après avoir consulté le plus proche parent de
l’ancien combattant dont le décès lui a été signalé :
a) fournit une garde d’honneur
composée d’au moins deux membres des Forces canadiennes en uniforme qui sont
présents à la cérémonie funèbre de l’ancien combattant;
b) prend les mesures voulues pour
que le drapeau canadien orne le cercueil ou l’urne contenant les restes de
l’ancien combattant;
c) s’il y a lieu, prévoit une salve
d’honneur ou des honneurs militaires semblables;
d) prévoit les autres honneurs
qu’il estime, après consultation du plus proche parent, nécessaires ou
souhaitables pour l’occasion.

5. (1) The Minister shall cause to be laid
before the House of Commons, on any of the first fifteen days on which that
House is sitting after the end of each fiscal year, a report on the operation
of the program.

A report laid under subsection (1) shall be referred to the standing
committee appointed to deal with matters relating to veterans affairs.

6. The Governor in Council may make regulations
for carrying into effect the purposes and provisions of this Act, including
regulations

(a) prescribing persons who may be considered as next of
kin of a veteran;
(b) prescribing the manner of reporting the death of a
veteran to the Minister;
(c) prescribing the types of funeral honours to be granted;
and
(d) prescribing what constitutes an honourable release in
any given case.
