Sommaire

This enactment would ensure that no member of the House of Commons shall sit therein and that no funds shall be made available to the member for the carrying out of parliamentary functions unless he or she takes an oath or makes a solemn affirmation of loyalty to Canada.

Le texte fait en sorte qu’un député ne peut siéger à la Chambre des communes ni se voir accorder des fonds dans le cadre de ses fonctions parlementaires à moins de prêter serment ou faire une affirmation solennelle de loyauté envers le Canada.

This declaration is in addition to the oath of allegiance to Her Majesty provided for in the Constitution Act, 1867.

Cette déclaration vient s’ajouter au serment d’allégeance à Sa Majesté prévu par la Loi constitutionnelle de 1867.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 13(2) of the Parliament of Canada Act is replaced by the following:

(2) Every oath and solemn affirmation and declaration under this Part shall be in the Forms 1 and 2 in Schedule 1.

27.1 No person holding a seat in the House of Commons shall sit therein nor shall any funds be made available to such a person for the carrying out of parliamentary functions unless the person, in writing, has taken the oath or made the solemn affirmation provided for in Schedule 2 before the Governor General or any person authorized by the Governor General to administer such oath or solemn affirmation.

27.1 Un député ne peut siéger à la Chambre des communes ni se voir accorder des fonds dans le cadre de ses fonctions parlementaires à moins d’avoir, par écrit, prêté le serment ou fait l’affirmation solennelle prévus à l’annexe 2 devant le gouverneur général ou toute personne autorisée par lui à cet effet.

4. Subsection 50(5) of the Act is replaced by the following:

(5) Every member of the Board shall, as soon as practicable after becoming a member of the Board, take before the Clerk of the House of Commons an oath or affirmation of fidelity and secrecy in the form set out in Form 3 of the Schedule 1.
