SUMMARY

Short Title

Short title

1 This Act may be cited as the National Strategy for the Prevention of Intimate Partner Violence Act.

Interpretation

Definitions

2 The following definitions apply in this Act.

intimate partner, with respect to a person, includes their current or former spouse, common-law partner and dating partner. (Version anglaise seulement)

medical practitioner means a person who is entitled to practise medicine under the laws of a province. (médecin)

Minister means the Minister for Women and Gender Equality and Youth. (ministre)

nurse practitioner means a registered nurse who, under the laws of a province, is entitled to practise as a nurse practitioner — or under an equivalent designation — and to autonomously make diagnoses, order and interpret diagnostic tests, prescribe substances and treat patients. National Strategy for the Prevention of Intimate Partner Violence

National strategy

3 (1) The Minister must develop a national strategy for the prevention of intimate partner violence.

Consultations

(2) In developing the national strategy for the prevention of intimate partner violence, the Minister must consult with other federal ministers, representatives of provincial governments who are responsible for social development, families and public safety, and representatives of groups who provide services to or advocate on behalf of victims of intimate partner violence, with respect to

• (a) the adequacy of current programs and strategies aimed at preventing intimate partner violence and at protecting and assisting victims of intimate partner violence;

• (b) partnerships between police services, health care facilities, advocacy groups and shelters in the prevention of intimate partner violence and the protection of victims of intimate partner violence;

• (c) the requirements for representatives of health care facilities, medical practitioners and nurse practitioners to provide information on access to legal assistance to patients who they suspect may be victims of intimate partner violence;

• (d) the requirements for health professionals to make a report to the police if they suspect that a patient is a victim of intimate partner violence;

• (e) the financial and other costs of implementing the national strategy; and

• (f) any constitutional, legal or jurisdictional implications of implementing the national strategy.

Initiation of consultations

(3) The consultation referred to in subsection (2) must begin within one year after the day on which this Act receives royal assent.

Report and Publication

Report to Parliament

4 (1) The Minister must prepare a report setting out the national strategy and cause a copy of the report to be tabled in each House of Parliament no later than two years after the day on which this Act receives royal assent.

Publication of report

(2) The Minister must post the report on the departmental website within 30 days after the day on which the report is tabled in both Houses of Parliament.

Review and Report

Two-year review

5 (1) Two years after the tabling of the report referred to in section 4, the Minister must commence a review of the implementation of the national strategy. At the conclusion of the review, the Minister must prepare a report setting out his or her conclusions and recommendations regarding the strategy.

Tabling of report

(2) The Minister must cause a copy of the report on the review to be tabled in each House of Parliament on any of the first 15 days on which that House is sitting after the day on which the report is completed.
