SOMMAIRE
Le texte modifie la Loi sur la radiocommunication afin de prévoir l’obligation pour les titulaires de licences de spectre de déployer le spectre à au moins 50 % de la population dans la zone géographique couverte par la licence de spectre.
SUMMARY
This enactment amends the Radiocommunication Act to require spectrum licence holders to deploy the spectrum to at least 50% of the population within the geographic area covered by the spectrum licence.

1 (1) La Loi sur la radiocommunication est modifiée par adjonction, après le paragraphe 5(1.1), de ce qui suit :
1 (1) The Radiocommunication Act is amended by adding the following after subsection 5(1.1):

(1.11) Toute licence de spectre délivrée en vertu du sous-alinéa (1)a)(i.1) — autre qu’une licence à l’égard de l’utilisation de fréquences de radiocommunication dans une zone de service de niveau 5 selon l’avis DGSO-006-19, Décisions sur un nouvel ensemble de zones de service pour y effectuer la délivrance de licences de spectre, publié dans la Gazette du Canada le 23 juillet 2019 — est assortie de la condition que le titulaire déploie le spectre de manière à fournir des services à au moins 50 % de la population dans la zone géographique couverte par la licence dans les trois ans suivant la délivrance de celle-ci.
End of inserted block(1.11) It is a condition of every licence issued under subparagraph (1)(a)(i.1) — other than a licence in respect of the utilization of radio frequencies within a Tier 5 service area as described in Canada Gazette notice DGSO-006-19, Decision on a New Set of Service Areas for Spectrum Licensing, published on July 23, 2019 — that the holder must deploy the spectrum to provide service to at least 50% of the population within the geographic area covered by the spectrum licence within three years of the licence’s issuance.

(2) The Act is amended by adding the following after subsection 5(2):

(3) Malgré le paragraphe (2) et sous réserve du paragraphe (4), le ministre peut, s’il est convaincu que le titulaire d’une licence de spectre n’a pas respecté la condition prévue au paragraphe (1.11), annuler la licence en transmettant au titulaire un avis d’annulation précisant la date d’entrée en vigueur de l’annulation fixée selon le paragraphe (5).
End of inserted block(3) Despite subsection (2) and subject to subsection (4), the Minister may, if the Minister is satisfied that the holder of a spectrum licence has not complied with the condition set out in subsection (1.11), revoke the licence by providing a notice of revocation to the holder that specifies the effective date of the revocation as determined under subsection (5).

(4) Le ministre ne peut annuler une licence de spectre au titre du paragraphe (3) qu’après avoir donné un avis écrit au titulaire et accordé la possibilité à celui-ci de lui présenter ses observations à l’égard de l’avis.
End of inserted block(4) The Minister must not revoke a spectrum licence under subsection (3) unless the Minister has given written notice to the holder and has provided the holder with a reasonable opportunity to make representations to the Minister with respect to the notice.

(5) La date d’entrée en vigueur de l’avis d’annulation visé au paragraphe (3) est :
a) soit la date à laquelle le ministre envoie l’avis d’annulation, si le titulaire n’utilise pas la licence de spectre pour fournir des services à la population dans la zone géographique couverte par la licence;
b) soit cent quatre-vingts jours suivant la date à laquelle le ministre envoie l’avis d’annulation, dans les autres cas.
End of inserted block(5) The effective date of a notice of revocation provided under subsection (3) is,
(a) if the holder is not using the spectrum licence to provide any service to the population within the geographic area covered by the spectrum licence, the day on which the notice of revocation is sent by the Minister; or
(b) in any other case, 180 days after the day on which the notice of revocation is sent by the Minister.

End of inserted block(6) During the period, if any, between a notice of revocation provided under subsection (3) and its effective date, the Minister may consent to an arrangement under which the holder of the spectrum licence arranges for the provision of the service to the population within the geographic area covered by the licence to be assumed by another person.

(7) Le titulaire d’une licence de spectre devant être annulée au titre du paragraphe (3) qui est incapable de prendre des mesures pour confier à une autre personne la prestation des services est responsable des pertes ou des dommages subis par toute personne dans la zone géographique couverte par la licence et peut être poursuivi en dommages-intérêts devant un tribunal compétent à moins qu’il ait renoncé à la licence en avisant le ministre par écrit. Malgré le paragraphe (2), toute licence remise au moyen d’un avis écrit est réputée annulée le jour de l’envoi de l’avis de renonciation.
End of inserted block(7) If the holder of a spectrum licence that is to be revoked under subsection (3) is unable to arrange for service to be assumed by another person, that holder is liable for any loss or damage suffered by any person within the geographic area covered by the licence and may be sued for damages in a court of competent jurisdiction unless that holder has surrendered the licence to the Minister by written notice. Despite subsection (2), a licence surrendered upon written notice is deemed to be revoked on the day the notice of surrender was sent.

Reissuance of spectrum licence
(8) En cas d’annulation d’une licence de spectre conformément au paragraphe (4), le ministre est tenu, dans les soixante jours suivant la date d’entrée en vigueur de l’avis d’annulation, de recourir à un processus d’adjudication pour réattribuer la licence.
End of inserted block(8) If a spectrum licence has been revoked under subsection (4), the Minister must, within 60 days of the effective date of the notice of revocation, use a system of competitive bidding to select the person to whom the licence will be reissued.

2 (1) Subject to subsection (2), subsection 5(1.11) of the Radiocommunication Act applies in respect of any licence issued under subparagraph 5(1)(a)(i.1) of that Act that is in force immediately before this Act comes into force.
