SUMMARY

This enactment amends the Canada Labour Code to provide that, in calculating the time in respect of which an employee who is a flight attendant is to be paid, the employer must include the time that the employee spends in carrying out their pre-flight and post-flight duties and in completing mandatory training programs.

An Act to amend the Canada Labour Code (hours of work of flight attendants)

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1This Act may be cited as the Fairness for Flight Attendants Act.

2Section 169 of the Canada Labour Code is amended by adding the following after subsection (1):

Calculation of hours of work — flight attendants

(1.‍1)In calculating the time worked in a day or in a week, as the case may be, for which an employee who is a flight attendant is to be paid, the employer must include the time that the employee spends in
  • (a)carrying out all pre-flight and post-flight duties relating to aircraft security and passenger service, including assisting with embarking and disembarking and pre-flight cabin and passenger safety checks;

  • (b)completing mandatory training programs; and

  • (c)attending at the work place at the call of the employer and at the disposal of the employer, including during a flight delay, whether or not the delay is within the employer’s control.

3The Act is amended by adding the following after section 181:

181.‍01An order or regulation must not be made under this Part that has the effect of limiting the application of subsection 169(1.‍1).
