SOMMAIRE
Le texte modifie le Code criminel afin d’élargir, en ce qui touche l’infraction de voies de fait, la circonstance aggravante concernant les conducteurs de véhicules de transport en commun de manière à inclure tous les employés de services de transport en commun.
SUMMARY
This enactment amends the Criminal Code, in relation to the offence of assault, to expand the aggravating circumstance of assaulting a public transit operator to include all public transit workers.

1 L’article 269.01 du Code criminel est remplacé par ce qui suit :
1 Section 269.01 of the Criminal Code is replaced by the following:
Circonstance aggravante — voies de fait contre un employé d’un service de transport en commun
Aggravating circumstance — assault against a public transit worker
269.01 (1) Le tribunal qui détermine la peine à infliger à l’égard d’une infraction prévue à l’alinéa 264.1(1)a) ou à l’un des articles 266 à 269 est tenu de considérer comme circonstance aggravante le fait que la victime est l’ Insertion start employé d’un service de Insertion end transport en commun qui exerçait cette fonction au moment de la perpétration de l’infraction.
269.01 (1) When a court imposes a sentence for an offence referred to in paragraph 264.1(1)(a) or any of sections 266 to 269, it shall consider as an aggravating circumstance the fact that the victim of the offence was, at the time of the commission of the offence, a public transit Insertion start worker Insertion end engaged in the performance of Insertion start their Insertion end duty.

(2) Au présent article, service de transport en commun s’entend d’un service de transport de passagers offert au public — y compris tout service de transport adapté et d’autobus scolaire — au moyen d’un véhicule tel qu’un autobus, un train, un métro, un tramway, un traversier ou un taxi agréé.
End of inserted block(2) In this section, public transit means a passenger transportation service provided to the public — including paratransit and school bus services — using a vehicle such as a bus, train, subway, tram, ferry or licensed taxi cab.
