SOMMAIRE
Le texte modifie le Code criminel afin d’exiger que le tribunal considère comme circonstance aggravante le fait qu’une personne a eu en sa possession une arme à l’intérieur d’un hôpital ou près de celui-ci, sur le terrain d’un hôpital ou près de ce terrain ou à l’intérieur de tout autre établissement de santé public ou près d’un tel établissement.
SUMMARY
This enactment amends the Criminal Code to require the court to consider as an aggravating circumstance the fact that a person was in possession of a weapon in or near a hospital, on or near hospital grounds or in or near any other public health care facility.
Il modifie également la Loi réglementant certaines drogues et autres substances afin d’empêcher le ministre d’accorder une exemption qui entraînerait l’utilisation illicite ou non prescrite d’une substance désignée dans un hôpital.
It also amends the Controlled Drugs and Substances Act to prevent the Minister from granting an exemption that would result in the illicit or unprescribed use of a controlled substance in a hospital.

2 L’article 88 du Code criminel est modifié par adjonction, après le paragraphe (2), de ce qui suit :

(3) Sans que soit limitée la portée générale de l’article 718.2, le tribunal qui détermine la peine à infliger à la personne déclarée coupable de l’infraction prévue au paragraphe (1) est tenu de considérer comme circonstance aggravante le fait que l’infraction a été commise à l’intérieur d’un hôpital ou près de celui-ci, sur le terrain d’un hôpital ou près de ce terrain ou à l’intérieur de tout autre établissement de santé public ou près d’un tel établissement.
End of inserted block(3) Without limiting the generality of section 718.2, if a person is convicted of an offence under subsection (1), the court imposing the sentence shall consider as an aggravating circumstance the fact that the offence was committed in or near a hospital, on or near hospital grounds or in or near any other public health care facility.

(4) Il est entendu que la paragraphe (3) ne s’applique pas à l’utilisation prescrite d’une substance désignée dans un hôpital par un patient avec l’autorisation et sous la supervision d’un praticien.
