SUMMARY

This enactment amends the Canada Shipping Act, 2001 in order for a foreign national who holds a diploma issued by a prescribed Canadian maritime institution and for whom a permanent residence application is being processed to be eligible for a certificate of competency.

An Act to amend the Canada Shipping Act, 2001 (certificate of competency)

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Canada Shipping Act, 2001

1The definition qualified person in section 2 of the Canada Shipping Act, 2001 is amended by striking out “or” at the end of paragraph (a) and by adding the following after that paragraph:

  • Start of inserted block

    (a.‍1)a foreign national within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who is referred to in subsection 88(1); or

    End of inserted block

2Subsection 88(1) of the Act is replaced by the following:

Holder of a certificate of competency

88(1)Only Insertion start the following persons Insertion end may hold a certificate of competency that is issued under this Part:
  • ( Insertion start a Insertion end )a Canadian citizen;

  • ( Insertion start b Insertion end )a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act;

  • Start of inserted block

    (c)a foreign national within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act who holds a diploma issued by a prescribed Canadian maritime institution and for whom a permanent residence application under that Act is being processed.‍

    End of inserted block

3Section 100 of the Act is amended by adding the following after paragraph (c):

  • Start of inserted block

    (c.‍1)designating Canadian maritime institutions for the purpose of subsection 88(1);

    End of inserted block
