SOMMAIRE
Le texte modifie la Loi sur les épaves et les bâtiments abandonnés ou dangereux afin de prévoir l’élaboration et la mise en œuvre d’une stratégie nationale visant à contrer l’abandon de bâtiments.
SUMMARY
This enactment amends the Wrecked, Abandoned or Hazardous Vessels Act to provide for the development and implementation of a national strategy to address the abandonment of vessels.

1 L’article 2 de la Loi sur les épaves et les bâtiments abandonnés ou dangereux est modifié par adjonction, selon l’ordre alphabétique, de ce qui suit :
1 Section 2 of the Wrecked, Abandoned or Hazardous Vessels Act is amended by adding the following definition in alphabetical order:
corps dirigeant autochtone Conseil, gouvernement ou autre entité autorisé à agir pour le compte d’un groupe, d’une collectivité ou d’un peuple autochtones titulaires de droits reconnus et confirmés par l’article 35 de la Loi constitutionnelle de 1982. (Indigenous governing body)

129.1 (1) Le ministre élabore et met en œuvre une stratégie nationale visant à contrer l’abandon de bâtiments.
End of inserted block129.1 (1) The Minister must develop and implement a national strategy to address the abandonment of vessels.

(2) La stratégie prévoit des mesures visant à :
a) élaborer un régime permettant l’identification rapide et efficace des propriétaires de bâtiments;
b) évaluer si les droits pour couvrir les frais de disposition des bâtiments sont appropriés;
c) élaborer un programme de dépôt dans lequel, notamment, sont désignées des zones d’immersion pour les bâtiments;
d) élaborer des initiatives novatrices de recyclage d’épaves et de leurs pièces, assorties de normes contraignantes pour atténuer les impacts sociaux et environnementaux;
e) élaborer un plan d’amarrage pour les bâtiments;
f) soutenir les entreprises locales offrant des services d’assistance;
g) améliorer le processus de disposition des épaves et des bâtiments abandonnés.

(a) develop a system to promptly and effectively identify the owners of vessels;
(b) evaluate the adequacy of fees in respect of the disposition cost of vessels;
(c) develop a turn-in program that includes the designation of disposal areas for vessels;
(d) develop innovative recycling initiatives for wrecked vessels and their components, along with enforceable standards to reduce environmental and social impacts;
(e) develop a mooring plan for vessels;
(f) provide support to local businesses offering salvage services; and
(g) improve the process for disposing of wrecked and abandoned vessels.

(3) La stratégie prévoit aussi :
a) une évaluation du caractère suffisant des ressources affectées à la prévention de l’abandon de bâtiments et à la prise de mesures pour y faire face, notamment celles de la Garde côtière canadienne;
b) lorsque cela est indiqué, une coopération et un partenariat avec les gouvernements des provinces et les corps dirigeants autochtones pour mettre en œuvre les mesures prévues au paragraphe (2) et évaluer les échéanciers nécessaires pour ce faire.

(a) include an assessment of the adequacy of the resources, including those of the Canadian Coast Guard, dedicated to preventing and responding to the abandonment of vessels; and
(b) provide for, where appropriate, cooperation and partnership with provincial governments and Indigenous governing bodies on the implementation of any measures referred to in subsection (2), and for an assessment of the timelines required to do so.

129.2 (1) Dans l’année qui suit la date d’entrée en vigueur de la présente loi, le ministre établit un rapport exposant la stratégie nationale et son calendrier de mise en œuvre et le fait déposer devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant son achèvement.
End of inserted block129.2 (1) Within one year after the day on which this Act comes into force, the Minister must prepare a report setting out the national strategy and the schedule for its implementation and cause it to be tabled in each House of Parliament on any of the first 15 days on which that House is sitting after it is completed.

129.3 (1) Au cours de l’année du deuxième anniversaire de l’entrée en vigueur de la présente loi et chaque année par la suite, le ministre établit un rapport sur les progrès réalisés dans la mise en œuvre de la stratégie nationale et sur les modifications qui y ont été apportées.
End of inserted block129.3 (1) The Minister must, during the year in which the second anniversary of the coming into force of this Act occurs and each year after that, prepare a report on the progress made in implementing the national strategy and any changes made to it.
