SOMMAIRE
Le texte modifie la Loi sur le Service canadien du renseignement de sécurité afin de prévoir que le Service canadien du renseignement de sécurité doit faire rapport sur les manquements à son obligation de franchise envers les tribunaux. Il modifie également le serment professionnel que prêtent le directeur et les employés afin qu’ils promettent solennellement de s’acquitter de cette obligation.
SUMMARY
This enactment amends the Canadian Security Intelligence Service Act to provide that the Canadian Security Intelligence Service shall report on breaches of its duty of candour to the courts. It also amends the oath of office taken by the Director and employees to include a solemn promise to fulfill that duty.

1 L’article 6 de la Loi sur le Service canadien du renseignement de sécurité est modifié par adjonction, après le paragraphe (6), de ce qui suit :
1 Section 6 of the Canadian Security Intelligence Service Act is amended by adding the following after subsection (6):
Manquements à l’obligation de franchise
Breaches of duty of candour
(7) Les rapports incluent également :
a) le nombre de fois où le Service, dans l’exercice des fonctions qui lui sont conférées en vertu de la présente loi en ce qui a trait aux demandes de mandat, a manqué ou peut avoir manqué à son obligation de franchise envers les tribunaux;
b) une description de chaque manquement;
c) des renseignements sur toute mesure corrective prise par le Service à l’égard de chaque manquement.
End of inserted block(7) The reports shall also include
(a) the number of times that the Service has or may have breached its duty of candour to the courts in the performance of its duties and functions under this Act in relation to applications for warrants;
(b) a description of each breach; and
(c) information on any remedial measures taken by the Service in response to each breach.

20.2 Dans les trois mois suivant la fin de chaque année civile, le Service présente au ministre son rapport d’activité pour l’année précédente, Insertion start lequel comprend une description générale des renseignements fournis en application du paragraphe 6(7) pour la même période Insertion end , et Insertion start le ministre Insertion end le fait déposer devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant sa réception.
20.2 The Service shall, within three months after the end of each calendar year, submit to the Minister a report of the activities of the Service during the preceding calendar year, Insertion start including a general description of the information provided under subsection 6(7) for the same period Insertion end , and the Minister shall cause the report to be laid before each House of Parliament on any of the first 15 days on which that House is sitting after the Minister receives it.
