SOMMAIRE
Le texte modifie la Loi sur l’immigration et la protection des réfugiés afin d’autoriser le gouverneur en conseil, après consultation des provinces, à prendre des règlements concernant la reconnaissance des titres de compétences étrangers.
SUMMARY
This enactment amends the Immigration and Refugee Protection Act to authorize the Governor in Council, after consultation with the provinces, to make regulations in relation to the recognition of foreign credentials.

Préambule
Attendu :
que le gouvernement du Canada s’engage à ce que le système d’immigration permette au Canada d’accueillir de nouveaux arrivants de partout dans le monde;
que le gouvernement du Canada s’engage à assurer l’intégration des résidents permanents dans la société canadienne;
que le gouvernement du Canada croit que la reconnaissance des titres de compétences étrangers des résidents permanents est essentielle à la réussite de leur intégration;
que certains nouveaux arrivants au Canada désireux d’exercer certaines professions ou certains métiers sont confrontés à des obstacles et à de l’incertitude en ce qui a trait à l’évaluation de leurs diplômes par des organisations canadiennes et, lorsqu’il s’agit de professions ou de métiers exigeant un permis délivré par une autorité fédérale ou provinciale, en ce qui a trait à la probabilité qu’ils obtiennent ce permis;
que le gouvernement du Canada s’engage à collaborer avec les provinces pour faire en sorte que les titres de compétences étrangers des résidents permanents soient reconnus à leur juste valeur et à accroître la transparence des processus d’évaluation des titres de compétences et de délivrance de permis afin de favoriser un climat de certitude pour les personnes qui désirent exercer leur profession ou leur métier au Canada,
Preamble
Whereas the Government of Canada is committed to an immigration system that allows Canada to welcome newcomers from around the world;
Whereas the Government of Canada is committed to the successful integration of permanent residents into Canadian society;
Whereas the Government of Canada acknowledges that recognizing the foreign credentials of permanent residents is essential to their successful integration;
Whereas some newcomers to Canada seeking to work in certain professions or trades face hurdles and uncertainty regarding the assessment of their educational credentials by Canadian organizations and, in the case of professions or trades for which licensing by a federal or provincial authority is required, regarding the likelihood of their being licensed by that authority;
And whereas the Government of Canada is committed to securing, in cooperation with the provinces, due recognition of the foreign credentials of permanent residents and to enhancing the transparency of the credential assessment and licensing processes in order to promote certainty for those seeking to practise their profession or trade in Canada;

87.41 (1) Le gouverneur en conseil peut, par règlement, sur la recommandation du ministre de l’Emploi et du Développement social et après consultation par celui-ci des provinces et du ministre du Travail, préciser, en ce qui concerne les étrangers qui présentent une demande de visa de résident permanent au titre de la catégorie réglementaire des travailleurs qualifiés (fédéral) ou d’une catégorie visée par une instruction donnée en vertu de l’alinéa 10.3(1)a), les diplômes, certificats ou attestations étrangers qui sont équivalents à un diplôme canadien pour l’application de la présente loi.
End of inserted block87.41 (1) The Governor in Council, on the recommendation of the Minister of Employment and Social Development, after consultation by the Minister with the provinces and the Minister of Labour, may make regulations prescribing the foreign diplomas, certificates or credentials of foreign nationals who apply for permanent resident visas as members of the prescribed class of federal skilled workers or of a class referred to in an instruction given under paragraph 10.3(1)(a) that are equivalent to Canadian educational credentials for the purposes of this Act.

(2) Au présent article, diplôme canadien s’entend de tout diplôme d’études secondaires ou tout diplôme, certificat ou attestation postsecondaires obtenu pour avoir réussi un programme canadien d’études ou un cours de formation offert par un établissement d’enseignement ou de formation reconnu par les autorités provinciales chargées d’enregistrer, d’accréditer, de superviser et de réglementer de tels établissements.
End of inserted block(2) In this section, Canadian educational credential means any secondary school diploma or any post-secondary diploma, certificate or credential that is issued on the completion of a Canadian program of study or training at an educational or training institution that is recognized by the provincial authorities responsible for registering, accrediting, supervising and regulating such institutions.
