SUMMARY
Le texte modifie le Code criminel afin de prévoir une responsabilité pénale pour les crimes violents d’intention générale commis par une personne alors qu’elle est en état d’intoxication volontaire extrême et négligente.
This enactment amends the Criminal Code to provide for criminal liability for violent crimes of general intent committed by a person while in a state of negligent self-induced extreme intoxication.

33.1 (1) La personne qui, en raison de son intoxication volontaire extrême, n’a pas l’intention générale ou la volonté habituellement requise pour commettre une infraction visée au paragraphe (3) la commet tout de même si :
a) d’une part, tous les autres éléments constitutifs de celle-ci sont présents;
b) d’autre part, avant de se trouver dans un état d’intoxication extrême, elle s’est écartée de façon marquée de la norme de diligence attendue d’une personne raisonnable, dans les circonstances, relativement à la consommation de substances intoxicantes.
33.1 (1) A person who, by reason of self-induced extreme intoxication, lacks the general intent or voluntariness ordinarily required to commit an offence referred to in subsection (3), nonetheless commits the offence if
(a) all the other elements of the offence are present; and
(b) before they were in a state of extreme intoxication, they departed markedly from the standard of care expected of a reasonable person in the circumstances with respect to the consumption of intoxicating substances.

(2) Pour décider si la personne s’est écartée de façon marquée de la norme de diligence, le tribunal prend en compte la prévisibilité objective du risque que la consommation des substances intoxicantes puisse provoquer une intoxication extrême et amener la personne à causer un préjudice à autrui. Dans sa prise de décision, il prend aussi en compte toute circonstance pertinente, notamment ce que la personne a fait afin d’éviter ce risque.
(2) For the purposes of determining whether the person departed markedly from the standard of care, the court must consider the objective foreseeability of the risk that the consumption of the intoxicating substances could cause extreme intoxication and lead the person to harm another person. The court must, in making the determination, also consider all relevant circumstances, including anything that the person did to avoid the risk.

(3) Le présent article s’applique aux infractions créées par la présente loi ou toute autre loi fédérale dont l’un des éléments constitutifs est l’atteinte ou la menace d’atteinte à l’intégrité physique d’une personne, ou toute forme de voies de fait.
(3) This section applies in respect of an offence under this Act or any other Act of Parliament that includes as an element an assault or any other interference or threat of interference by a person with the bodily integrity of another person.

(4) Au présent article, extrême se dit de l’intoxication qui rend une personne incapable de se maîtriser consciemment ou d’avoir conscience de sa conduite.
(4) In this section, extreme intoxication means intoxication that renders a person unaware of, or incapable of consciously controlling, their behaviour.
