SUMMARY
This enactment amends the Federal-Provincial Fiscal Arrangements Act to provide that a province with a program whose objectives are comparable to those of a federal program in an area under the legislative authority of the province may withdraw from the federal program.
It also amends that Act and the Canada Health Act in order to exempt Quebec from the national criteria and conditions set out for the Canada Health Transfer.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Federal-Provincial Fiscal Arrangements Act
1 Section 24 of the Federal-Provincial Fiscal Arrangements Act is renumbered as subsection 24(1) and is amended by adding the following:

(2) Quebec is exempt from the application of paragraph (1)(a).

30.1 (1) A province that has a program whose objectives are comparable to those of a federal program may, at any time, choose to withdraw from the federal program, in which case it shall receive the same financial contribution it would have received had it not withdrawn.

(2) In subsection (1), federal program means any plan under which the federal government undertakes to pay a financial contribution for the achievement of national objectives in an area under the legislative authority of the provinces.

Canada Health Act
3 Section 7 of the Canada Health Act is renumbered as subsection 7(1) and is amended by adding the following:

(2) Quebec is exempt from the application of subsection (1) and is to receive the full cash contribution referred to in section 5.
