SOMMAIRE
SUMMARY
Le texte modifie le Code criminel afin d’ériger en infraction le fait de commettre un méfait à l’égard d’un monument ou d’une structure similaire érigés en l’honneur de premiers intervenants.
This enactment amends the Criminal Code to provide for the offence of committing mischief in relation to a monument or similar structure that honours first responders.

Préambule
Attendu :
que les premiers intervenants mettent régulièrement en péril leur propre vie et leur bien-être physique, émotionnel et mental pour sauver la vie d’autres personnes;
que, partout au Canada, diverses structures — monuments, statues, cénotaphes — sont érigées en hommage aux premiers intervenants pour honorer leur héroïsme et leur sacrifice;
que les actes de vandalisme contre ces structures portent outrage à la mémoire des premiers intervenants et au service qu’ils ont rendu à la collectivité;
que quiconque se rend coupable d’un méfait à l’égard d’une telle structure devrait être passible d’une peine considérable,
Preamble
Whereas first responders regularly put their own lives and physical, emotional and mental well-being at risk in order to save the lives of others;
Whereas, for their selfless heroism, first responders are honoured and commemorated with various memorials, statues, cenotaphs and other structures throughout Canada;
Whereas vandalism against these memorials, statues, cenotaphs and other structures dishonours the memory of these first responders and their service to the community;
And whereas significant penalties should be imposed against any person convicted of mischief against a memorial, statue, cenotaph or other structure honouring first responders;

1 L’article 430 du Code criminel est modifié par adjonction, après le paragraphe (4.11), de ce qui suit :
1 Section 430 of the Criminal Code is amended by adding the following after subsection (4.11):
Méfait : monuments aux premiers intervenants
Mischief related to memorials to first responders
(4.12) Quiconque commet un méfait à l’égard de tout ou partie d’un bâtiment ou d’une structure servant principalement de monument érigé en l’honneur de premiers intervenants — notamment une statue ou un monument —, d’un objet servant à honorer ces personnes ou à en rappeler le souvenir et se trouvant dans un tel bâtiment ou une telle structure ou sur le terrain où ceux-ci sont situés, ou d’un cimetière, est coupable d’une infraction punissable sur déclaration de culpabilité par procédure sommaire ou par mise en accusation et est passible :
a) que l’infraction soit poursuivie par mise en accusation ou par procédure sommaire, des peines minimales suivantes :
(i) pour la première infraction, une amende minimale de mille dollars,
(ii) pour la seconde infraction, un emprisonnement minimal de quatorze jours,
(iii) pour chaque infraction subséquente, un emprisonnement minimal de trente jours;
b) si l’infraction est poursuivie par mise en accusation, d’un emprisonnement maximal de dix ans;
c) si l’infraction est poursuivie par procédure sommaire, d’un emprisonnement maximal de dix-huit mois.
End of inserted block(4.12) Everyone who commits mischief in relation to property that is a building or structure or part of a building or structure that primarily serves as a monument to honour first responders — including a statue or monument — or an object associated with honouring or remembering those persons if that object is located in or on the grounds of such a building or structure, or a cemetery is guilty of an indictable offence or an offence punishable on summary conviction and is liable,
(a) whether the offence is prosecuted by indictment or punishable on summary conviction, to the following minimum punishment:
(i) for a first offence, to a fine of not less than $1,000,
(ii) for a second offence, to imprisonment for not less than 14 days, and
(iii) for each subsequent offence, to imprisonment for not less than 30 days;
(b) if the offence is prosecuted by indictment, to imprisonment for a term not exceeding 10 years; or
(c) if the offence is punishable on summary conviction, to imprisonment for a term not exceeding 18 months.

Definition of first responders
(4.13) Au paragraphe (4.12), premiers intervenants s’entend des personnes qui assurent des services d’urgence, notamment les policiers, pompiers et ambulanciers paramédicaux, et vise également les membres des Forces canadiennes qui assurent de tels services.
End of inserted block(4.13) In subsection (4.12), first responders means any persons who provide emergency services, including police officers, firefighters and paramedics, and includes members of the Canadian Forces who provide those services.
