SOMMAIRE
Le texte modifie la Loi sur le droit d’auteur afin d’autoriser une personne à contourner une mesure technique de protection qui protège un programme d’ordinateur dans le seul but d’effectuer tout diagnostic, tout entretien ou toute réparation sur un produit auquel le programme est intégré. Il autorise aussi la fabrication, l’importation, la distribution, la vente, la location et la fourniture de technologies, de dispositifs ou de composants servant aux diagnostics, entretiens et réparations sur de tels produits.
SUMMARY
This enactment amends the Copyright Act in order to allow the circumvention of a technological protection measure in a computer program if the circumvention is solely for the purpose of diagnosis, maintenance or repair of a product in which the program is embedded. It also allows the manufacture, importation, distribution, sale, renting and provision of technologies, devices or components used for diagnosis, maintenance or repair of such products.

1 (1) L’alinéa a) de la définition de contourner, à l’article 41 de la Loi sur le droit d’auteur, est remplacé par ce qui suit :
1 (1) Paragraph (a) of the definition circumvent in section 41 of the Copyright Act is replaced by the following:
-
a) S’agissant de la mesure technique de protection au sens de l’alinéa a) de la définition de ce terme, éviter, supprimer, désactiver ou entraver la mesure — notamment décoder ou déchiffrer l’œuvre Insertion start ou le programme d’ordinateur protégés Insertion end par la mesure — sans l’autorisation du titulaire du droit d’auteur;
-
(a) in respect of a technological protection measure within the meaning of paragraph (a) of the definition technological protection measure, to descramble a scrambled work Insertion start or computer program Insertion end , or decrypt an encrypted work Insertion start or computer program Insertion end or to otherwise avoid, bypass, remove, deactivate or impair the technological protection measure, unless it is done with the authority of the copyright owner; and
(2) L’alinéa a) de la définition de mesure technique de protection, à l’article 41 de la même loi, est remplacé par ce qui suit :
(2) Paragraph (a) of the definition technological protection measure in section 41 of the Act is replaced by the following:

a) soit contrôle efficacement l’accès à une œuvre, Insertion start y compris un programme d’ordinateur Insertion end , à une prestation fixée au moyen d’un enregistrement sonore ou à un enregistrement sonore et est autorisé par le titulaire du droit d’auteur;

41.121 (1) L’alinéa 41.1(1)a) ne s’applique pas à la personne qui contourne la mesure technique de protection qui contrôle l’accès à un programme d’ordinateur dans le seul but d’effectuer tout diagnostic, tout entretien ou toute réparation sur un produit auquel il est intégré.
End of inserted block41.121 (1) Paragraph 41.1(1)(a) does not apply to a person who circumvents a technological protection measure that controls access to a computer program if the person does so for the sole purpose of diagnosing, maintaining or repairing a product in which the computer program is embedded.

End of inserted block(2) Paragraph 41.1(1)(c) does not apply to a person who manufactures, imports or provides a technology, device or component for the purposes of circumventing a technological protection measure that controls access to a computer program if the person does so for the purpose of diagnosing, maintaining or repairing a product in which the program is embedded and
(a) uses that technology, device or component only for that purpose; or
(b) provides that technology, device or component to another person solely for that purpose.
