SOMMAIRE
Le texte modifie la Loi sur les aliments et drogues afin d’interdire les essais de cosmétiques sur des animaux et la vente de cosmétiques créés ou fabriqués par un procédé comportant des essais de cosmétiques sur des animaux. Il prévoit aussi qu’aucune preuve découlant d’essais sur des animaux ne peut être utilisée pour établir l’innocuité d’un cosmétique.
SUMMARY
This enactment amends the Food and Drugs Act to prohibit cosmetic animal testing and the sale of cosmetics developed or manufactured using cosmetic animal testing. It also provides that no evidence derived from animal testing may be used to establish the safety of a cosmetic.

2 L’article 2 de la Loi sur les aliments et drogues est modifié par adjonction, selon l’ordre alphabétique, de ce qui suit :

animal testing means the topical application or internal administration of any substance to a live non-human vertebrate to evaluate its safety or efficacy.
cosmetic animal testing means the topical application or internal administration of any cosmetic or ingredient of any cosmetic to a live non-human vertebrate to evaluate its safety or efficacy for the purpose of developing or manufacturing a cosmetic.
3 L’article 16 de la même loi est modifié par adjonction, après l’alinéa c), de ce qui suit :
3 Section 16 of the Act is amended by striking out “or” at the end of paragraph (b), by adding “or” at the end of paragraph (c) and by adding the following after paragraph (c):

18.1 Il est interdit de présenter ou d’utiliser une preuve découlant d’essais sur des animaux effectués plus de quatre ans après la date d’entrée en vigueur du présent article afin d’établir l’innocuité d’un cosmétique ou d’un ingrédient d’un cosmétique sous le régime de la présente loi ou de ses règlements.
18.1 No evidence derived from animal testing conducted more than four years after the day on which this section comes into force may be submitted or used to establish the safety of a cosmetic or an ingredient of a cosmetic under this Act or the regulations.

18.2 (1) L’alinéa 16d) et les articles 16.1 et 18.1 ne s’appliquent pas aux essais sur des animaux autorisés par le ministre, selon les modalités règlementaires, lorsqu’il n’existe aucun autre moyen de procéder à l’évaluation de problèmes spécifiques et avérés de santé humaine liés à un cosmétique ou à l’ingrédient d’un cosmétique dont l’utilisation est largement répandue et qui ne peut être remplacé par un autre cosmétique ou ingrédient d’un cosmétique pouvant remplir une fonction semblable.
18.2 (1) Paragraph 16(d) and sections 16.1 and 18.1 do not apply to animal testing authorized by the Minister, in prescribed form and manner, when there is no alternative method to evaluate substantiated specific human health problems associated with a cosmetic or ingredient of a cosmetic that is in wide use and cannot be replaced by another cosmetic or ingredient of a cosmetic capable of performing a similar function.

(2) Le ministre, après en avoir donné avis selon les modalités règlementaires, tient des consultations publiques avant d’émettre une autorisation en vertu du paragraphe (1).
(2) The Minister shall, after having given notice in the prescribed form and manner, conduct public consultations before issuing an authorization under subsection (1).

18.3 Le gouverneur en conseil peut, par règlement, assimiler toute drogue à un cosmétique pour l’application de l’alinéa 16d) et des articles 16.1, 18.1 et 18.2.
18.3 The Governor in Council may designate, by regulation, a drug that is to be treated as a cosmetic for the purposes of paragraph 16(d) and sections 16.1, 18.1 and 18.2.
