SUMMARY
This enactment provides for the development and implementation of a national strategy to enable the return of Indigenous human remains and cultural property to the Indigenous peoples of Canada.

3 Le ministre, en coopération avec des représentants des Premières Nations, des Inuits et des Métis ainsi que des représentants des provinces Insertion start et des territoires, et en conformité avec la Déclaration des Nations Unies sur les droits des peuples autochtones, notamment l’article 31 de celle-ci Insertion end , élabore et met en œuvre une stratégie nationale globale visant à promouvoir et à soutenir la restitution de Insertion start restes humains ou de Insertion end biens culturels autochtones, peu importe où Insertion start ils Insertion end se trouvent, aux peuples autochtones du Canada. La stratégie prévoit notamment des mesures visant à :
-
a) mettre en œuvre un mécanisme permettant aux communautés et aux organisations de membres des Premières Nations, d’Inuits et de Métis d’acquérir ou de réacquérir des Insertion start restes humains ou des Insertion end biens culturels autochtones;
-
b) inciter les propriétaires, les gardiens et les fiduciaires de Insertion start restes humains ou de Insertion end biens culturels autochtones à les restituer aux peuples autochtones et soutenir ceux-ci dans le processus;
-
c) favoriser la reconnaissance Insertion start que Insertion end la préservation des Insertion start restes humains et des Insertion end biens culturels autochtones et Insertion start que leur Insertion end accès à des fins éducatives ou cérémonielles Insertion start sont des Insertion end principes d’égale importance;
-
d) dans le cadre du rapatriement des Insertion start restes humains ou des Insertion end biens culturels autochtones, inciter les parties prenantes à tenir compte du savoir traditionnel et non uniquement de la preuve documentaire;
-
e) Insertion start résoudre Insertion end des revendications contradictoires Insertion start de communautés ou d’organisations Insertion end autochtones, Insertion start ou parmi leurs membres, à l’égard de restes humains ou de biens culturels Insertion end autochtones, Insertion start d’une manière qui respecte les Insertion end traditions autochtones et Insertion start les Insertion end différents régimes de propriété autochtones et Insertion start qui permet aux Insertion end demandeurs Insertion start de Insertion end se Insertion start représenter Insertion end eux-mêmes.
3 The Minister, in cooperation with representatives of First Nations, Inuit and Métis peoples of Canada, and of the provinces Insertion start and territories, in accordance with the United Nations Declaration on the Rights of Indigenous Peoples, including Article 31 of that text, Insertion end must develop and implement a comprehensive national strategy to promote and support the return of Insertion start Indigenous human remains and Insertion end cultural property, wherever situated, to the Insertion start Indigenous Insertion end peoples of Canada. The strategy must include measures Insertion start that seek Insertion end to
-
(a) implement a mechanism by which any First Nation, Inuit or Métis community or organization may acquire or reacquire Insertion start Indigenous human remains or Insertion end cultural property;
-
(b) encourage owners, custodians or trustees of Insertion start Indigenous human remains Insertion end or cultural property to return such Insertion start material Insertion end to Insertion start Indigenous Insertion end peoples and support them in the process;
-
(c) support the recognition Insertion start that Insertion end preservation of Insertion start Indigenous human remains and Insertion end cultural property and of access to that Insertion start material Insertion end for educational and ceremonial purposes Insertion start are Insertion end principles of equal importance;
-
(d) encourage consideration of traditional ways of knowing rather than relying on strict documentary evidence in relation to the repatriation of Insertion start Indigenous human remains and Insertion end cultural property; and
-
(e) Insertion start resolve any Insertion end conflicting claims Insertion start to Indigenous human remains or cultural property, whether within or between Indigenous communities or organizations, in a manner Insertion end that is respectful of Insertion start Indigenous Insertion end traditional processes and forms of ownership and Insertion start that allows Insertion end claimants Insertion start to be Insertion end self-represented.

4 (1) Dans les Insertion start trois Insertion end ans suivant la date d’entrée en vigueur de la présente loi, le ministre établit un rapport énonçant la stratégie nationale et le fait déposer devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant son achèvement.
4 (1) Within Insertion start three Insertion end years after the day on which this Act comes into force, the Minister must prepare a report setting out the national strategy and cause the report to be laid before each House of Parliament on any of the first 15 days on which that House is sitting after the report is completed.

(2) Dans les dix jours suivant la date de dépôt du rapport au Parlement, le ministre le publie sur le site Web du ministère du Patrimoine canadien et le diffuse dans les communautés et organisations de membres des Premières Nations, d’Inuits et de Métis du Canada.
(2) The Minister must publish the report on the Department of Canadian Heritage website within 10 days after the day on which the report is tabled in Parliament and ensure its dissemination to First Nations, Inuit and Métis communities and organizations in Canada.

Le rapport Insertion start peut notamment comporter Insertion end des renseignements Insertion start appropriés sur les restes humains et Insertion end les biens culturels autochtones qui ont été rapatriés et sur les efforts de rapatriement qui sont actuellement déployés.
5 (1) Within two years after the tabling of the report referred to in section 4, the Minister must prepare a report on the effectiveness of the national strategy. The report must include the Minister’s conclusions and recommendations regarding the strategy Insertion start and any outcomes that Insertion end result Insertion start from its Insertion end implementation Insertion start and it may include appropriate Insertion end information on repatriated Insertion start Indigenous human remains and Insertion end cultural property Insertion start and any Insertion end repatriation efforts currently under way.
