SOMMAIRE
Le texte modifie le Code canadien du travail afin d’interdire la prise de mesures disciplinaires contre les pompiers volontaires qui doivent quitter leur lieu de travail ou ne pas s’y présenter pour intervenir à ce titre.
SUMMARY
This enactment amends the Canada Labour Code to prohibit disciplinary action against volunteer firefighters who must leave work or fail to appear at work in order to act in that capacity.
Il modifie également la Loi sur l’assurance-emploi afin d’y prévoir qu’un prestataire demeure admissible à l’assurance-emploi pour toute journée où il fournit des services de pompier volontaire.
It also amends the Employment Insurance Act to provide that claimants remain eligible for employment insurance for any day on which they provide services as a volunteer firefighter.

246.1 (1) L’employeur ne peut, sans motif valable, empêcher un employé d’agir à titre de pompier appelé sur une base ponctuelle (appelé « pompier volontaire » dans la présente loi) si celui-ci l’a informé de ses obligations, notamment que, s’il est appelé à intervenir, il devra quitter précipitamment son lieu de travail ou ne pourra pas s’y présenter.
End of inserted block246.1 (1) No employer shall, without good cause, prevent an employee from acting as a firefighter called on an occasional basis (in this Act referred to as a “volunteer firefighter”) if the employee has informed the employer of their obligations, in particular that if called to act in that capacity, they will have to leave work suddenly or will not be able to appear at work.

(2) L’employeur ne peut, sans motif valable, ni invoquer le fait que l’employé est pompier volontaire pour le congédier, le suspendre, le mettre à pied, le rétrograder ou prendre des mesures disciplinaires contre lui, ni en tenir compte dans ses décisions en matière d’avancement ou de formation, si celui-ci l’a informé de ses obligations et l’avise, lorsqu’il est appelé à intervenir, qu’il doit quitter son lieu de travail précipitamment ou ne peut pas s’y présenter.
End of inserted block(2) No employer shall, without good cause, dismiss, suspend, lay off, demote or discipline an employee because they are a volunteer firefighter nor take into account the fact that an employee is a volunteer firefighter in a decision to promote or train them if the employee has informed the employer of their obligations and advises the employer when, to act in that capacity, they must leave work suddenly or are not able to appear at work.

(3) Pour l’application de l’alinéa (1)d), services de pompier volontaire s’entend des services fournis à un service d’incendie par un particulier en sa qualité de pompier appelé sur une base ponctuelle, qui consistent principalement à intervenir et à assurer la permanence en cas d’incendie ou de situation d’urgence connexe, à assister à des réunions tenues par le service d’incendie et à participer aux activités de formation obligatoires liées à la prévention ou à l’extinction d’incendies. En sont exclus les services de lutte contre les incendies fournis à un service d’incendie autrement qu’à titre de pompier appelé sur une base ponctuelle.
End of inserted block(3) For the purposes of paragraph (1)(d), services as a volunteer firefighter means services provided to a fire department by an individual in their capacity as a firefighter on an occasional basis that consist primarily in responding to and being on call for firefighting and related emergency calls, attending meetings held by the fire department and participating in required training related to the prevention or suppression of fires, but does not include firefighting services provided to a fire department otherwise than as a firefighter on an occasional basis.
