SUMMARY
This enactment amends the Payments in Lieu of Taxes Act in order to provide that, in the event of a disagreement about the property value or effective rate applicable to the federal property that is a national historic site, an assessment of the property value and effective rate applicable to that property may be conducted by a third party.

An Act to amend the Payments in Lieu of Taxes Act (independent assessment)
R.S., c. M-13; 2000, c. 8, s. 1
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. (1) The portion of subsection 4(1) of the Payments in Lieu of Taxes Act before paragraph (a) is replaced by the following:
Payments in lieu of real property tax
4. (1) Subject to subsections (2) to (4) and 5(1) and (2), a payment referred to in paragraph 3(1)(a) shall not exceed the product of
(2) Section 4 of the Act is amended by adding the following after subsection (3):
National historic sites
(4) If the federal property has been subject to an assessment under section 8.1, the effective rate and the property value applicable to that federal property, referred to respectively in paragraphs (1)(a) and (b), shall be those contained in the report referred to in subsection 8.1(5).
2. The Act is amended by adding the following after section 8:
National historic sites
8.1 (1) In the event that a taxing authority disagrees with the property value or effective rate applicable to the federal property that is a national historic site, the taxing authority may elect to have the property value and effective rate assessed by a third party.
Third-party assessment
(2) The assessment of the property value and effective rate applicable to the federal property shall be done by an assessor chosen by mutual consent of the Minister and the taxing authority.
Disagreement
(3) If there is no agreement on the appointment of an assessor within 90 days after the election referred to in subsection (1) was made, the taxing authority shall submit to the advisory panel a list containing the names of at least three assessors, and the panel shall appoint an assessor from that list within 30 days after the receipt of the list.
Fees
(4) The taxing authority shall pay the assessor’s fees.
Report
(5) The assessor shall submit, to the Minister and taxing authority, a report containing the result of his or her assessment of the property value and effective rate applicable to the federal property in question.
Assessment final
(6) The assessment of the property value and effective rate contained in the report is binding on the Minister and the taxing authority for the taxation year in question.
