SUMMARY
This enactment amends the Carriage by Air Act in order to specify that that Act does not restrict the fundamental rights guaranteed under the Official Languages Act and the Canadian Human Rights Act.

An Act to amend the Carriage by Air Act (fundamental rights)
Whereas Parliament is the guarantor of fundamental rights in Canada;
Whereas respect for fundamental rights is one of the cornerstones of Canadian democracy;
Whereas human rights and language rights are fundamental rights in Canada;
Whereas nothing in the preparatory work for or implementation of the Convention for the Unification of Certain Rules Relating to International Carriage by Air suggests that Canada intended to renounce its fundamental rights;
Whereas the Air Carriage Act should implement this convention in a manner that respects the fundamental rights recognized by Canadian law;
And whereas Parliament must see to it that these fundamental rights are respected at all times, including in respect of international air carriage;

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. The Carriage by Air Act is amended by adding the following after section 3:
Interpretation
3.1 (1) Nothing in this Act shall be construed as limiting
(a) the power to grant a remedy, including damages, under subsection 77(4) of the Official Languages Act; or
(b) the power to order redress measures under subsection 53(2) or (3) of the Canadian Human Rights Act.
Clarification
(2) For greater certainty, subsection (1) applies only if the cause of action for a remedy is not explicitly provided for in any of Articles 17 to 19 of the Convention set out in Schedule VI.
