Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Criminal Code is amended by adding the following after section 443:
|
|
|
|

Interference with critical infrastructure
|
|
443.1 (1) Every person commits an offence who, wilfully and without lawful excuse,
|
|
|
|
(a) destroys or damages any part of a critical infrastructure;
|
|
|
|
(b) renders any part of a critical infrastructure dangerous, useless, inoperative or ineffective; or
|
|
|
|
(c) obstructs, interrupts or interferes with the lawful use, enjoyment or operation of any part of a critical infrastructure.
|

|
|
443.1 (1) Commet une infraction quiconque volontairement et sans excuse légitime, selon le cas :
|
|
Porter atteinte à une infrastructure essentielle
|
|
a) détruit ou détériore une partie d’une infrastructure essentielle;
|
|
|
|
b) rend une partie d’une infrastructure essentielle dangereuse, inutile, inopérante ou inefficace;
|
|
|
|
c) empêche, interrompt ou gêne l’emploi, la jouissance ou l’exploitation légitime d’une partie d’une infrastructure essentielle.

Punishment
|
|
(2) Subject to subsection (3), every person who commits an offence under subsection (1) is guilty of
|
|
|
|
(a) an indictable offence and liable to a minimum fine of $3,000 and imprisonment for a term not exceeding ten years; or
|
|
|
|
(b) an offence punishable on summary conviction and liable to a minimum fine of $500 and imprisonment for a term not exceeding two years less a day.
|
|
|
|
(2) Sous réserve du paragraphe (3), quiconque commet une infraction visée au paragraphe (1) est coupable :
|
|

a) soit d’un acte criminel et passible d’une amende minimale de trois mille dollars et d’un emprisonnement maximal de dix ans;
|
|
|
|
b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire et passible d’une amende minimale de cinq cents dollars et d’un emprisonnement maximal de deux ans moins un jour.

(3) Every person who commits an offence under subsection (1) that causes actual danger to life is guilty of an indictable offence and liable to imprisonment for life.

(3) Est coupable d’un acte criminel et passible de l’emprisonnement à perpétuité quiconque commet une infraction visée au paragraphe (1) et qui, ce faisant, cause un danger réel pour la vie des gens.

Consecutive sentences
|
|
(4) Any sentence imposed on a person for an offence under subsection (1) must be served consecutively to any other punishment imposed on the person for an offence arising out of the same event or series of events.
|

Definition of “critical infrastructure”
|
|
(5) In this section, “critical infrastructure” means a publicly or privately owned facility, network, service or asset that provides or distributes services for the benefit of the public, including services relating to energy, telecommunications, finance, health care, food, water, transportation, public safety, government and manufacturing, the disruption of which could produce serious adverse economic effects or endanger the health or safety of Canadians.

(5) Au présent article, « infrastructure essentielle » s’entend des installations, réseaux, services ou biens publics ou privés servant à la fourniture de services publics, y compris ceux liés à l’énergie, aux télécommunications, aux finances, à la santé, à l’alimentation, à l’eau, au transport, à la sécurité publique, à l’administration publique et à l'industrie manufacturière, dont la perturbation est susceptible d'avoir une incidence grave sur l'économie ou de mettre en danger la santé ou la sécurité de la population canadienne.
