An Act to amend the Criminal Code (critical infrastructure)
R.S., c. C-46
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. (1) The heading “WILFUL AND FORBIDDEN ACTS IN RESPECT OF CERTAIN PROPERTY” before section 428 of the Criminal Code is replaced by the following:
WILFUL AND FORBIDDEN ACTS IN RESPECT OF CERTAIN PROPERTY AND CRITICAL INFRASTRUCTURE
(2) Section 428 of the Act is renumbered as subsection 428(1) and is amended by adding the following:
Definition of “critical infrastructure”
(2) In this Part, “critical infrastructure” means those physical and information technology facilities, networks, services and assets whose disruption or destruction would have a serious impact on the health, safety, security or economic well-being of Canadians or the effective functioning of governments in Canada, including the facilities, networks, services and assets in the following fields:
(a) energy and utilities (e.g., electrical power, natural gas and oil production and transmission systems);
(b) communications and information technology (e.g., telecommunications and broadcasting systems, software, hardware and networks, including the Internet);
(c) finances (e.g., banking, securities and investments);
(d) health care (e.g., hospitals, health care facilities, blood banks, laboratories and pharmaceutical facilities);
(e) food (e.g., safety, distribution, agriculture and food industry);
(f) water (e.g., drinking water and wastewater management);
(g) transportation (e.g., air, rail, marine and surface);
(h) safety (e.g., chemical, biological, radiological and nuclear safety, hazardous materials, search and rescue, emergency services and dams);
(i) government (e.g., services, facilities, information networks, assets and key national sites and monuments); and
(j) manufacturing (e.g., defence industrial base and chemical industry).
2. Section 430 of the Act is amended by adding the following after subsection (1.1):
Mischief in relation to a critical infrastructure
(1.2) Every one commits mischief who steals copper wire or copper pipes from a critical infrastructure.
